| 10 | 10 | SECTION 1. Chapter 48, Penal Code, is amended by adding | |
| 11 | 11 | Section 48.05 to read as follows: | |
| 12 | 12 | Sec. 48.05. PROHIBITION ON URINATING OR DEFECATING IN | |
| 13 | 13 | PUBLIC PLACE. (a) A person commits an offense if the person | |
| 14 | 14 | intentionally or knowingly urinates or defecates in a public place, | |
| 15 | 15 | other than a public restroom. | |
| 16 | 16 | (b) An offense under this section is a Class B misdemeanor. | |
| 17 | 17 | (c) If conduct that constitutes an offense under this | |
| 18 | 18 | section also constitutes an offense under another law, the actor | |
| 19 | 19 | may be prosecuted under this section, the other law, or both. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2021. |
