A BILL TO BE ENTITLED
AN ACT
relating to prohibiting urination or defecation in certain public
places; creating a criminal offense.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 48, Penal Code, is amended by adding
Section 48.05 to read as follows:
Sec. 48.05. PROHIBITION ON URINATING OR DEFECATING IN
PUBLIC PLACE. (a) A person commits an offense if the person
intentionally or knowingly urinates or defecates in a public place,
other than a public restroom.
(b) An offense under this section is a Class B misdemeanor.
(c) If conduct that constitutes an offense under this
section also constitutes an offense under another law, the actor
may be prosecuted under this section, the other law, or both.
SECTION 2. This Act takes effect September 1, 2021.
