7 | 7 | | relating to the duties of the Texas Economic Development and |

8 | 8 | | Tourism Office's business permit office. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 481.123, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 481.123. DUTIES. The permit office shall: |
---|
13 | 13 | | (1) provide comprehensive information on permits |
---|
14 | 14 | | required for business enterprises in the state and make that |
---|
15 | 15 | | information available to applicants and other persons; |
---|
16 | 16 | | (2) assist applicants in obtaining timely and |
---|
17 | 17 | | efficient permit review and in resolving issues arising from the |
---|
18 | 18 | | review; |
---|
19 | 19 | | (3) facilitate contacts between applicants and state |
---|
20 | 20 | | agencies responsible for processing and reviewing permit |
---|
21 | 21 | | applications; |
---|
22 | 22 | | (4) assist applicants in the resolution of outstanding |
---|
23 | 23 | | issues identified by state agencies, including delays experienced |
---|
24 | 24 | | in permit review; |
---|
25 | 25 | | (5) develop comprehensive application procedures to |
---|
26 | 26 | | expedite the permit process; |
---|
27 | 27 | | (6) compile a comprehensive list of all permits |
---|
28 | 28 | | required of a person desiring to establish, operate, or expand a |
---|
29 | 29 | | business enterprise in the state; |
---|
30 | 30 | | (7) encourage and facilitate the participation of |
---|
31 | 31 | | federal and local government agencies in permit coordination; |
---|
32 | 32 | | (8) make recommendations for eliminating, |
---|
33 | 33 | | consolidating, simplifying, expediting, or otherwise improving |
---|
34 | 34 | | permit procedures affecting business enterprises by requesting |
---|
35 | 35 | | that the state auditor, with the advice and support of the permit |
---|
36 | 36 | | office, initiate a business permit reengineering review process |
---|
37 | 37 | | involving all state agencies; |
---|
38 | 38 | | (9) develop and implement an outreach program to |
---|
39 | 39 | | publicize and make small business entrepreneurs and others aware of |
---|
40 | 40 | | services provided by the permit office; |
---|
41 | 41 | | (10) adopt rules, procedures, instructions, and forms |
---|
42 | 42 | | required to carry out the functions, powers, and duties of the |
---|
43 | 43 | | permit office under this subchapter; [and] |
---|
44 | 44 | | (11) except as provided in Section 481.129, complete |
---|
45 | 45 | | the implementation of the business permit review process on or |
---|
46 | 46 | | before September 1, 1994, and provide all recommended statutory |
---|
47 | 47 | | changes as needed to the legislature on or before January 1, 1995; |
---|
48 | 48 | | and |
---|
49 | 49 | | (12) conduct the biennial review required under |
---|
50 | 50 | | Section 481.130. |
---|
51 | 51 | | SECTION 2. Subchapter H, Chapter 481, Government Code, is |
---|
52 | 52 | | amended by adding Section 481.130 to read as follows: |
---|
53 | 53 | | Sec. 481.130. BIENNIAL REVIEW OF PERMIT APPLICATION |
---|
54 | 54 | | PROCESS. At least once every two years, the permit office shall: |
---|
55 | 55 | | (1) conduct a formal review to evaluate the permit |
---|
56 | 56 | | application process, including: |
---|
57 | 57 | | (A) creating a flowchart of the process to assist |
---|
58 | 58 | | in identifying deficiencies in the process; and |
---|
59 | 59 | | (B) identifying ways in which the process can be |
---|
60 | 60 | | simplified or expedited; and |
---|
61 | 61 | | (2) based on the findings of the review: |
---|
62 | 62 | | (A) make recommendations for state agencies to |
---|
63 | 63 | | improve the permit application process; and |
---|
64 | 64 | | (B) revise the comprehensive application |
---|
65 | 65 | | procedure under 481.124 and any information prepared by the permit |
---|
66 | 66 | | office, including the handbook under Section 481.125, as necessary |
---|
67 | 67 | | to make the procedure and information more user-friendly. |
---|
68 | 68 | | SECTION 3. Not later than December 1, 2022, the Texas |
---|
69 | 69 | | Economic Development and Tourism Office's business permit office |
---|
70 | 70 | | shall complete the first review required by Section 481.130, |
---|
71 | 71 | | Government Code, as added by this Act. |
---|
72 | 72 | | SECTION 4. This Act takes effect September 1, 2021. |
