A BILL TO BE ENTITLED
AN ACT
relating to authorizing the online ordering and purchasing of
alcoholic beverages.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 102, Alcoholic Beverage
Code, is amended by adding Section 102.23 to read as follows:
Sec. 102.23. INTERNET PURCHASES AND ORDERS AUTHORIZED. (a)
Subject to the limitations of this subchapter, Subchapter B, and
other applicable provisions of this code, any purchase or order
that is authorized by this code to be made by a distributor from a
manufacturer, by a retailer from a distributor, or by an ultimate
consumer from a retailer may be made through an Internet website.
(b) The commission by rule shall establish measures to
ensure that Internet purchases authorized under this section comply
with any requirements regarding age and other applicable provisions
of this code.
SECTION 2. This Act takes effect September 1, 2021.
