| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 41, Election Code, is |
|---|
| 11 | 11 | | amended by adding Section 41.003 to read as follows: |

| 12 | 12 | | Sec. 41.003. ELECTION OF EXECUTIVE OFFICERS AND MEMBERS OF |
|---|
| 13 | 13 | | LEGISLATURE. (a) Notwithstanding any other law, the election for |
|---|
| 14 | 14 | | an executive officer listed under Section 1, Article IV, Texas |
|---|
| 15 | 15 | | Constitution, other than the secretary of state, and for members of |
|---|
| 16 | 16 | | the legislature shall be held on the first Tuesday after the first |
|---|
| 17 | 17 | | Monday in November in odd-numbered years. |
|---|
| 18 | 18 | | (b) A law, rule, or provision that applies to the general |
|---|
| 19 | 19 | | election for state and county officers applies to an election held |
|---|
| 20 | 20 | | under this section. |
|---|
| 21 | 21 | | (c) The first election held under this section shall be held |
|---|
| 22 | 22 | | on November 7, 2023. A person who occupies an office pending the |
|---|
| 23 | 23 | | outcome of that election, either as a constitutional holdover from |
|---|
| 24 | 24 | | the prior term or through other law, is entitled to receive the |
|---|
| 25 | 25 | | emoluments of office until the successor qualifies for the office |
|---|
| 26 | 26 | | after the election. This subsection expires September 1, 2025. |

| 27 | 27 | | SECTION 2. This Act takes effect January 1, 2022. |
