 A BILL TO BE ENTITLED
 AN ACT
 relating to the date on which the election for statewide elected
 officials and members of the legislature is held.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter A, Chapter 41, Election Code, is
 amended by adding Section 41.003 to read as follows:
 Sec. 41.003.  ELECTION OF EXECUTIVE OFFICERS AND MEMBERS OF
 LEGISLATURE. (a)  Notwithstanding any other law, the election for
 an executive officer listed under Section 1, Article IV, Texas
 Constitution, other than the secretary of state, and for members of
 the legislature shall be held on the first Tuesday after the first
 Monday in November in odd-numbered years.
 (b)  A law, rule, or provision that applies to the general
 election for state and county officers applies to an election held
 under this section.
 (c)  The first election held under this section shall be held
 on November 7, 2023. A person who occupies an office pending the
 outcome of that election, either as a constitutional holdover from
 the prior term or through other law, is entitled to receive the
 emoluments of office until the successor qualifies for the office
 after the election. This subsection expires September 1, 2025.
 SECTION 2.  This Act takes effect January 1, 2022.
