| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Section 2155.445, Government Code, is amended by |
|---|
| 11 | 13 | | amending Subsection (b) and adding Subsection (e) to read as |
|---|
| 12 | 14 | | follows: |
|---|
| 13 | 15 | | (b) The comptroller regularly shall review and revise its |
|---|
| 14 | 16 | | procurement procedures and specifications for the purchase of goods |
|---|
| 15 | 17 | | to: |
|---|
| 16 | 18 | | (1) eliminate procedures and specifications that |
|---|
| 17 | 19 | | explicitly discriminate against recycled, remanufactured, or |
|---|
| 18 | 20 | | environmentally sensitive products, as those terms are defined by |
|---|
| 19 | 21 | | rule of the comptroller; [and] |
|---|
| 20 | 22 | | (2) encourage the use of recycled, remanufactured, or |
|---|
| 21 | 23 | | environmentally sensitive products; and |
|---|
| 22 | 24 | | (3) require that any information regarding the |
|---|
| 23 | 25 | | recycled, remanufactured, or environmentally sensitive nature of a |
|---|
| 24 | 26 | | product that is used as the basis for receiving a preference be |
|---|
| 25 | 27 | | certified as accurate by an entity approved by the comptroller. |
|---|
| 26 | 28 | | (e) A state agency shall provide notice of the preference |
|---|
| 27 | 29 | | under this section in all solicitation documents for purchases by |
|---|
| 28 | 30 | | the agency of goods for which the preference may be given, including |
|---|
| 29 | 31 | | the method the agency will use to evaluate, apply, and award the |
|---|
| 30 | 32 | | preference. |

| 31 | 33 | | SECTION 2. This Act takes effect September 1, 2021. |
