95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to the requirement that certain persons taking oysters on
128 a licensed commercial oyster boat obtain a commercial fisherman's
139 license.
1410 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1511 SECTION 1. Section 47.002(f), Parks and Wildlife Code, is
1612 amended to read as follows:
1713 (f) A person who takes or assists in taking oysters on a
1814 vessel licensed as a commercial oyster boat under Chapter 76 is
1915 [not] required to obtain or possess a general commercial
2016 fisherman's license unless the person holds a commercial oyster
2117 boat captain's license.
2218 SECTION 2. Section 76.101(d), Parks and Wildlife Code, is
2319 amended to read as follows:
2420 (d) Each member of the crew of a licensed commercial oyster
2521 boat is required to have a general commercial fisherman's license
2622 to take oysters while they are on a licensed boat that is being used
2723 to take oysters. This subsection does not apply to the captain of a
2824 licensed commercial oyster boat.
2925 SECTION 3. This Act takes effect immediately if it receives
3026 a vote of two-thirds of all the members elected to each house, as
3127 provided by Section 39, Article III, Texas Constitution. If this
3228 Act does not receive the vote necessary for immediate effect, this
3329 Act takes effect September 1, 2021.
