| 14 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 11 | | SECTION 1. Section 47.002(f), Parks and Wildlife Code, is |
|---|
| 16 | 12 | | amended to read as follows: |
|---|
| 17 | 13 | | (f) A person who takes or assists in taking oysters on a |
|---|
| 18 | 14 | | vessel licensed as a commercial oyster boat under Chapter 76 is |
|---|
| 19 | 15 | | [not] required to obtain or possess a general commercial |
|---|
| 20 | 16 | | fisherman's license unless the person holds a commercial oyster |
|---|
| 21 | 17 | | boat captain's license. |

| 22 | 18 | | SECTION 2. Section 76.101(d), Parks and Wildlife Code, is |
|---|
| 23 | 19 | | amended to read as follows: |
|---|
| 24 | 20 | | (d) Each member of the crew of a licensed commercial oyster |
|---|
| 25 | 21 | | boat is required to have a general commercial fisherman's license |
|---|
| 26 | 22 | | to take oysters while they are on a licensed boat that is being used |
|---|
| 27 | 23 | | to take oysters. This subsection does not apply to the captain of a |
|---|
| 28 | 24 | | licensed commercial oyster boat. |
|---|
| 29 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 29 | | Act takes effect September 1, 2021. |
