106 AN ACT
117 relating to the regulation of massage therapy.
128 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
139 SECTION 1. Section 455.152, Occupations Code, is amended to
1410 read as follows:
1511 Sec. 455.152. INELIGIBILITY FOR LICENSE. A person is not
1612 eligible for a license as a massage establishment, massage school,
1713 massage therapist, or massage therapy instructor if the person is
1814 an individual and has been convicted of, entered a plea of nolo
1915 contendere or guilty to, or received deferred adjudication for:
2016 (1) an offense under Chapter 20A, Penal Code, or
2117 Section 43.03, 43.031, 43.04, 43.041, or 43.05 [Subchapter A,
2218 Chapter 43], Penal Code; [,] or
2319 (2) an offense under federal law or the laws of another
2420 state containing elements that are substantially similar to the
2521 elements of an offense described by Subdivision (1) [another sexual
2622 offense].
2723 SECTION 2. Section 455.251, Occupations Code, is amended to
2824 read as follows:
2925 Sec. 455.251. GROUNDS FOR LICENSE DENIAL, [OR] DISCIPLINARY
3026 ACTION, OR ADMINISTRATIVE PENALTY. (a) The commission or
3127 executive director may refuse to issue a license to a person, [and
3228 shall] suspend, revoke, or refuse to renew the license of a person,
3329 or impose an administrative penalty under Subchapter F, Chapter 51,
3430 on [shall reprimand] a person licensed under this chapter if the
3531 person:
3632 (1) obtains or attempts to obtain a license by fraud,
3733 misrepresentation, or concealment of material facts;
3834 (2) sells, barters, or offers to sell or barter a
3935 license;
4036 (3) violates a rule adopted by the commission under
4137 this chapter;
4238 (4) engages in unprofessional conduct as defined by
4339 commission rule that endangers or is likely to endanger the health,
4440 welfare, or safety of the public;
4541 (5) violates an order or ordinance adopted by a
4642 political subdivision under Chapter 243, Local Government Code; or
4743 (6) violates this chapter.
4844 (b) The commission or executive director shall revoke the
4945 license of a person licensed as a massage therapist or massage
5046 therapy instructor if:
5147 (1) the person is convicted of, enters a plea of nolo
5248 contendere or guilty to, or receives deferred adjudication for:
5349 (A) an offense under Chapter 20A, Penal Code, or
5450 Section 43.03, 43.031, 43.04, 43.041, or 43.05, Penal Code
5551 [involving prostitution or another sexual offense]; or
5652 (B) an offense under federal law or the laws of
5753 another state containing elements that are substantially similar to
5854 the elements of an offense described by Paragraph (A); or
5955 (2) the commission or executive director determines
6056 the person has practiced or administered massage therapy at or for a
6157 sexually oriented business.
6258 (c) The commission or executive director:
6359 (1) shall revoke the license of a person licensed as a
6460 massage school or massage establishment if the commission or
6561 executive director determines that[:
6662 [(1)] the school or establishment is a sexually
6763 oriented business; and [or]
6864 (2) may revoke the license of a person licensed as a
6965 massage school or massage establishment if the commission or
7066 executive director determines that any of the following offenses
7167 occurred on the premises of the school or establishment and [an
7268 offense involving prostitution or another sexual offense that]
7369 resulted in a conviction for the offense, a plea of nolo contendere
7470 or guilty to the offense, or a grant of deferred adjudication for
7571 the offense:
7672 (A) an offense under Chapter 20A, Penal Code;
7773 (B) an offense under Subchapter A, Chapter 43,
7874 Penal Code;
7975 (C) an offense under federal law containing
8076 elements that are substantially similar to the elements of an
8177 offense described by Paragraph (A) or (B); or
8278 (D) another sexual offense under the laws of this
8379 state [occurred on the premises of the school or establishment].
8480 SECTION 3. As soon as practicable after the effective date
8581 of this Act, the Texas Commission of Licensing and Regulation shall
8682 adopt rules necessary to implement Sections 455.152 and 455.251,
8783 Occupations Code, as amended by this Act.
8884 SECTION 4. This Act takes effect September 1, 2021.
