| 5 | 11 | | relating to the authority of a county to require electronic bids or |
|---|
| 6 | 12 | | proposals for competitive bidding. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 262.0225, Local Government Code, is |
|---|
| 9 | 15 | | amended by amending Subsection (c) and adding Subsection (c-1) to |
|---|
| 10 | 16 | | read as follows: |
|---|
| 11 | 17 | | (c) A county may receive bids or proposals under this |
|---|
| 12 | 18 | | subchapter in hard-copy format or through electronic transmission. |
|---|
| 13 | 19 | | Except as provided by Subsection (c-1), a [A] county shall accept |
|---|
| 14 | 20 | | any bids or proposals submitted in hard-copy format. |
|---|
| 15 | 21 | | (c-1) The commissioners court of a county may by order |
|---|
| 16 | 22 | | require submission of bids or proposals under this subchapter |
|---|
| 17 | 23 | | through electronic transmission if the county makes available all |
|---|
| 18 | 24 | | technology necessary to submit a bid or proposal through electronic |
|---|
| 19 | 25 | | transmission to any person who submits a hard-copy bid or proposal |
|---|
| 20 | 26 | | in person. |
|---|
| 21 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 22 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 31 | | Act takes effect September 1, 2021. |
