9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the authority of a county to require electronic bids or
612 proposals for competitive bidding.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 262.0225, Local Government Code, is
915 amended by amending Subsection (c) and adding Subsection (c-1) to
1016 read as follows:
1117 (c) A county may receive bids or proposals under this
1218 subchapter in hard-copy format or through electronic transmission.
1319 Except as provided by Subsection (c-1), a [A] county shall accept
1420 any bids or proposals submitted in hard-copy format.
1521 (c-1) The commissioners court of a county may by order
1622 require submission of bids or proposals under this subchapter
1723 through electronic transmission if the county makes available all
1824 technology necessary to submit a bid or proposal through electronic
1925 transmission to any person who submits a hard-copy bid or proposal
2026 in person.
2127 SECTION 2. This Act takes effect immediately if it receives
2228 a vote of two-thirds of all the members elected to each house, as
2329 provided by Section 39, Article III, Texas Constitution. If this
2430 Act does not receive the vote necessary for immediate effect, this
2531 Act takes effect September 1, 2021.
