8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 15 | | SECTION 1. Section 521.1211, Transportation Code, is |
---|
10 | 16 | | amended to read as follows: |
---|
11 | 17 | | Sec. 521.1211. DRIVER'S LICENSE FOR PEACE OFFICERS AND |
---|
12 | 18 | | PROSECUTORS [OFFICER]. (a) In this section: |
---|
13 | 19 | | (1) "Peace [, "peace] officer" has the meaning |
---|
14 | 20 | | assigned by Article 2.12, Code of Criminal Procedure, except that |
---|
15 | 21 | | the term includes a special investigator as defined by Article |
---|
16 | 22 | | 2.122, Code of Criminal Procedure. |
---|
17 | 23 | | (2) "Prosecutor" means a county attorney, district |
---|
18 | 24 | | attorney, criminal district attorney, assistant county attorney, |
---|
19 | 25 | | assistant district attorney, or assistant criminal district |
---|
20 | 26 | | attorney. |
---|
21 | 27 | | (a-1) This section applies only to a peace officer and a |
---|
22 | 28 | | prosecutor. |
---|
23 | 29 | | (b) Notwithstanding Section 521.121(a), the department by |
---|
24 | 30 | | rule shall adopt procedures for the issuance of a driver's license |
---|
25 | 31 | | to an applicant [a peace officer] that omits the license holder's |
---|
26 | 32 | | actual residence address and includes, as an alternative, an |
---|
27 | 33 | | address described under Subsection (f) [that is acceptable to the |
---|
28 | 34 | | department and is in the: |
---|
29 | 35 | | [(1) municipality or county of the peace officer's |
---|
30 | 36 | | residence; or |
---|
31 | 37 | | [(2) county of the peace officer's place of |
---|
32 | 38 | | employment]. |
---|
33 | 39 | | (c) To be issued a driver's license under this section, an |
---|
34 | 40 | | applicant [a peace officer] must apply to the department and |
---|
35 | 41 | | provide sufficient evidence acceptable to the department to |
---|
36 | 42 | | establish the applicant's status as a person described under |
---|
37 | 43 | | Subsection (a-1) [peace officer]. On issuance of the license, the |
---|
38 | 44 | | license holder shall surrender any other driver's license issued to |
---|
39 | 45 | | the holder by the department. |
---|
40 | 46 | | (d) If the holder of a driver's license that includes an |
---|
41 | 47 | | alternative address moves to a new residence, or, for a prosecutor, |
---|
42 | 48 | | to a new office address, or if the name of the person is changed by |
---|
43 | 49 | | marriage or otherwise, the license holder shall, not later than the |
---|
44 | 50 | | 30th day after the date of the address or name change, notify the |
---|
45 | 51 | | department and provide the department with the number of the |
---|
46 | 52 | | person's driver's license and, as applicable, the person's: |
---|
47 | 53 | | (1) former and new addresses; or |
---|
48 | 54 | | (2) former and new names. |
---|
49 | 55 | | (e) If the holder of a driver's license that includes an |
---|
50 | 56 | | alternative address ceases to be a person described by Subsection |
---|
51 | 57 | | (a-1) [peace officer], the license holder shall, not later than the |
---|
52 | 58 | | 30th day after the date of the status change, apply to the |
---|
53 | 59 | | department for issuance of a duplicate license. The duplicate |
---|
54 | 60 | | license must include the person's actual current residence address. |
---|
55 | 61 | | (f) The department shall accept as an alternative address: |
---|
56 | 62 | | (1) for a peace officer, an address that is in the: |
---|
57 | 63 | | (A) municipality or county of the peace officer's |
---|
58 | 64 | | residence; or |
---|
59 | 65 | | (B) county of the peace officer's place of |
---|
60 | 66 | | employment; and |
---|
61 | 67 | | (2) for a prosecutor, the address of an office of the |
---|
62 | 68 | | prosecutor. |
---|
63 | 69 | | SECTION 2. Section 63.0101, Election Code, is amended by |
---|
64 | 70 | | adding Subsection (d) to read as follows: |
---|
65 | 71 | | (d) Pursuant to Section 63.001(c), proof of identification |
---|
66 | 72 | | is presented only for the purpose of identifying a voter and not for |
---|
67 | 73 | | verification of residence. |
---|
68 | 74 | | SECTION 3. This Act takes effect September 1, 2021. |
