410 AN ACT
511 relating to the issuance of a driver's license to certain persons
612 that includes an alternative to the license holder's residence
713 address.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 521.1211, Transportation Code, is
1016 amended to read as follows:
1117 Sec. 521.1211. DRIVER'S LICENSE FOR PEACE OFFICERS AND
1218 PROSECUTORS [OFFICER]. (a) In this section:
1319 (1) "Peace [, "peace] officer" has the meaning
1420 assigned by Article 2.12, Code of Criminal Procedure, except that
1521 the term includes a special investigator as defined by Article
1622 2.122, Code of Criminal Procedure.
1723 (2) "Prosecutor" means a county attorney, district
1824 attorney, criminal district attorney, assistant county attorney,
1925 assistant district attorney, or assistant criminal district
2026 attorney.
2127 (a-1) This section applies only to a peace officer and a
2228 prosecutor.
2329 (b) Notwithstanding Section 521.121(a), the department by
2430 rule shall adopt procedures for the issuance of a driver's license
2531 to an applicant [a peace officer] that omits the license holder's
2632 actual residence address and includes, as an alternative, an
2733 address described under Subsection (f) [that is acceptable to the
2834 department and is in the:
2935 [(1) municipality or county of the peace officer's
3036 residence; or
3137 [(2) county of the peace officer's place of
3238 employment].
3339 (c) To be issued a driver's license under this section, an
3440 applicant [a peace officer] must apply to the department and
3541 provide sufficient evidence acceptable to the department to
3642 establish the applicant's status as a person described under
3743 Subsection (a-1) [peace officer]. On issuance of the license, the
3844 license holder shall surrender any other driver's license issued to
3945 the holder by the department.
4046 (d) If the holder of a driver's license that includes an
4147 alternative address moves to a new residence, or, for a prosecutor,
4248 to a new office address, or if the name of the person is changed by
4349 marriage or otherwise, the license holder shall, not later than the
4450 30th day after the date of the address or name change, notify the
4551 department and provide the department with the number of the
4652 person's driver's license and, as applicable, the person's:
4753 (1) former and new addresses; or
4854 (2) former and new names.
4955 (e) If the holder of a driver's license that includes an
5056 alternative address ceases to be a person described by Subsection
5157 (a-1) [peace officer], the license holder shall, not later than the
5258 30th day after the date of the status change, apply to the
5359 department for issuance of a duplicate license. The duplicate
5460 license must include the person's actual current residence address.
5561 (f) The department shall accept as an alternative address:
5662 (1) for a peace officer, an address that is in the:
5763 (A) municipality or county of the peace officer's
5864 residence; or
5965 (B) county of the peace officer's place of
6066 employment; and
6167 (2) for a prosecutor, the address of an office of the
6268 prosecutor.
6369 SECTION 2. Section 63.0101, Election Code, is amended by
6470 adding Subsection (d) to read as follows:
6571 (d) Pursuant to Section 63.001(c), proof of identification
6672 is presented only for the purpose of identifying a voter and not for
6773 verification of residence.
6874 SECTION 3. This Act takes effect September 1, 2021.
