| 7 | 13 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 14 | SECTION 1. Section 1502.055, Government Code, is amended by | |
| 9 | 15 | adding Subsection (d) to read as follows: | |
| 10 | 16 | (d) Notwithstanding Subsection (a) or other law, a | |
| 11 | 17 | municipality is not required to hold an election to authorize the | |
| 12 | 18 | sale of a municipal retail water or sewer utility system if the | |
| 13 | 19 | Texas Commission on Environmental Quality has issued a notice of | |
| 14 | 20 | violation to the utility system and the governing body of the | |
| 15 | 21 | municipality finds by official action that the municipality is | |
| 16 | 22 | either financially or technically unable to restore the system to | |
| 17 | 23 | compliance with the applicable law or regulations. | |
| 18 | 24 | SECTION 2. This Act takes effect September 1, 2021. | |
