8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 15 | | SECTION 1. Section 104.07, Alcoholic Beverage Code, is |
---|
10 | 16 | | amended by adding Subsection (a-1) to read as follows: |
---|
11 | 17 | | (a-1) In addition to the notice required under Subsection |
---|
12 | 18 | | (a), the sign must include the contact information for reporting |
---|
13 | 19 | | suspicious activity to the Department of Public Safety. |
---|
14 | 20 | | SECTION 2. Section 102.101(b), Business & Commerce Code, is |
---|
15 | 21 | | amended to read as follows: |
---|
16 | 22 | | (b) The attorney general by rule shall prescribe the design, |
---|
17 | 23 | | content, and manner of display of the sign required by this |
---|
18 | 24 | | section. The sign must: |
---|
19 | 25 | | (1) be in both English and Spanish; [and] |
---|
20 | 26 | | (2) include the telephone number and Internet website |
---|
21 | 27 | | of the National Human Trafficking Resource Center; and |
---|
22 | 28 | | (3) include the contact information for reporting |
---|
23 | 29 | | suspicious activity to the Department of Public Safety. |
---|
24 | 30 | | SECTION 3. Section 125.002(f-1), Civil Practice and |
---|
25 | 31 | | Remedies Code, is amended to read as follows: |
---|
26 | 32 | | (f-1) If the defendant required to execute the bond is a |
---|
27 | 33 | | hotel, motel, or similar establishment that rents overnight lodging |
---|
28 | 34 | | to the public and the alleged common nuisance is under Section |
---|
29 | 35 | | 125.0015(a)(6) or (7), the bond must also be conditioned that the |
---|
30 | 36 | | defendant will, in each of the defendant's lodging units on the |
---|
31 | 37 | | premises that are the subject of the suit, post in a conspicuous |
---|
32 | 38 | | place near the room rate information required to be posted under |
---|
33 | 39 | | Section 2155.001, Occupations Code, a sign that includes: |
---|
34 | 40 | | (1) an operating toll-free telephone number of a |
---|
35 | 41 | | nationally recognized information and referral hotline for victims |
---|
36 | 42 | | of human trafficking; and |
---|
37 | 43 | | (2) the contact information for reporting suspicious |
---|
38 | 44 | | activity to the Department of Public Safety. |
---|
39 | 45 | | SECTION 4. Section 402.0351(b), Government Code, is amended |
---|
40 | 46 | | to read as follows: |
---|
41 | 47 | | (b) The attorney general by rule shall prescribe the design |
---|
42 | 48 | | and content of a sign regarding services and assistance available |
---|
43 | 49 | | to victims of human trafficking to be displayed at transportation |
---|
44 | 50 | | hubs. The sign must be in both English and Spanish and include: |
---|
45 | 51 | | (1) the telephone number and Internet website of the |
---|
46 | 52 | | National Human Trafficking Resource Center; [and] |
---|
47 | 53 | | (2) the contact information for reporting suspicious |
---|
48 | 54 | | activity to the Department of Public Safety; and |
---|
49 | 55 | | (3) the key indicators that a person is a victim of |
---|
50 | 56 | | human trafficking. |
---|
51 | 57 | | SECTION 5. Section 245.025, Health and Safety Code, is |
---|
52 | 58 | | amended by adding Subsection (a-1) to read as follows: |
---|
53 | 59 | | (a-1) In addition to the information required under |
---|
54 | 60 | | Subsection (a), the sign must include the contact information for |
---|
55 | 61 | | reporting suspicious activity to the Department of Public Safety. |
---|
56 | 62 | | SECTION 6. Section 455.207(b), Occupations Code, is amended |
---|
57 | 63 | | to read as follows: |
---|
58 | 64 | | (b) The sign required by this section must: |
---|
59 | 65 | | (1) be in English, Spanish, Korean, Mandarin, and any |
---|
60 | 66 | | other language required by commission rule; |
---|
61 | 67 | | (2) include a toll-free telephone number of a |
---|
62 | 68 | | nationally recognized information and referral hotline for victims |
---|
63 | 69 | | of human trafficking; [and] |
---|
64 | 70 | | (3) include the contact information for reporting |
---|
65 | 71 | | suspicious activity to the Department of Public Safety; and |
---|
66 | 72 | | (4) be displayed in a conspicuous place clearly |
---|
67 | 73 | | visible to the public. |
---|
68 | 74 | | SECTION 7. Section 1602.408(c), Occupations Code, is |
---|
69 | 75 | | amended to read as follows: |
---|
70 | 76 | | (c) The sign required by this section must be in English, |
---|
71 | 77 | | Spanish, and Vietnamese and include: |
---|
72 | 78 | | (1) a toll-free telephone number of a nationally |
---|
73 | 79 | | recognized information and referral hotline for victims of human |
---|
74 | 80 | | trafficking; and |
---|
75 | 81 | | (2) the contact information for reporting suspicious |
---|
76 | 82 | | activity to the Department of Public Safety. |
---|
77 | 83 | | SECTION 8. Not later than December 1, 2021, the Texas |
---|
78 | 84 | | Alcoholic Beverage Commission shall, in collaboration with the |
---|
79 | 85 | | Department of Public Safety of the State of Texas, develop guidance |
---|
80 | 86 | | for compliance with and notify affected license and permit holders |
---|
81 | 87 | | of the change in law made by this Act to Section 104.07, Alcoholic |
---|
82 | 88 | | Beverage Code. |
---|
83 | 89 | | SECTION 9. (a) Not later than December 1, 2021, the |
---|
84 | 90 | | attorney general shall, in collaboration with the Department of |
---|
85 | 91 | | Public Safety of the State of Texas, adopt the rules necessary to |
---|
86 | 92 | | implement the changes in law made by this Act to Section 102.101, |
---|
87 | 93 | | Business & Commerce Code, and Section 402.0351, Government Code. |
---|
88 | 94 | | (b) Not later than January 1, 2022: |
---|
89 | 95 | | (1) a sexually oriented business shall comply with |
---|
90 | 96 | | Section 102.101, Business & Commerce Code, as amended by this Act; |
---|
91 | 97 | | and |
---|
92 | 98 | | (2) a transportation hub shall comply with Section |
---|
93 | 99 | | 402.0351, Government Code, as amended by this Act. |
---|
94 | 100 | | SECTION 10. The change in law made by this Act to Section |
---|
95 | 101 | | 125.002, Civil Practice and Remedies Code, applies only to a suit |
---|
96 | 102 | | filed on or after the effective date of this Act. A suit filed |
---|
97 | 103 | | before the effective date of this Act is governed by the law in |
---|
98 | 104 | | effect immediately before that date, and that law is continued in |
---|
99 | 105 | | effect for that purpose. |
---|
100 | 106 | | SECTION 11. (a) Not later than December 1, 2021, the |
---|
101 | 107 | | executive commissioner of the Health and Human Services Commission |
---|
102 | 108 | | shall, in collaboration with the Department of Public Safety of the |
---|
103 | 109 | | State of Texas, adopt the rules necessary to implement the change in |
---|
104 | 110 | | law made by this Act to Section 245.025, Health and Safety Code. |
---|
105 | 111 | | (b) Not later than January 1, 2022, a hospital or abortion |
---|
106 | 112 | | facility shall comply with Section 245.025, Health and Safety Code, |
---|
107 | 113 | | as amended by this Act. |
---|
108 | 114 | | SECTION 12. (a) Not later than December 1, 2021, the Texas |
---|
109 | 115 | | Commission of Licensing and Regulation shall, in collaboration with |
---|
110 | 116 | | the Department of Public Safety of the State of Texas, adopt the |
---|
111 | 117 | | rules necessary to implement the changes in law made by this Act to |
---|
112 | 118 | | Sections 455.207 and 1602.408, Occupations Code. |
---|
113 | 119 | | (b) Not later than January 1, 2022: |
---|
114 | 120 | | (1) a massage establishment or massage school shall |
---|
115 | 121 | | comply with Section 455.207, Occupations Code, as amended by this |
---|
116 | 122 | | Act; and |
---|
117 | 123 | | (2) a licensed facility as defined by Section |
---|
118 | 124 | | 1602.408(a), Occupations Code, shall comply with Section 1602.408, |
---|
119 | 125 | | Occupations Code, as amended by this Act. |
---|
120 | 126 | | SECTION 13. This Act takes effect September 1, 2021. |
