11 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 10 | SECTION 1. This Act may be cited as the Entertainment and | |
13 | 11 | Hospitality Revitalization Act of 2021. | |
14 | 12 | SECTION 2. Chapter 217, Local Government Code, is amended | |
15 | 13 | by adding Subchapter Z to read as follows: | |
16 | 14 | SUBCHAPTER Z. MISCELLANEOUS PROVISIONS | |
17 | 15 | Sec. 217.901. REGULATION OF SOUND FROM CERTAIN VENUES IN | |
18 | 16 | CERTAIN MUNICIPALITIES PROHIBITED. (a) This section applies only | |
19 | 17 | to a municipality with a population of 750,000 or more that is | |
20 | 18 | primarily located in a county with a population of 1.5 million or | |
21 | 19 | less. | |
22 | 20 | (b) A municipality may not adopt or enforce an ordinance | |
23 | - | that regulates the production of amplified sound from a bar | |
24 | - | sound is produced: | |
21 | + | that regulates the production of amplified sound from a bar or live | |
22 | + | music venue located in a residential area if the sound is produced: | |
25 | 23 | (1) from a loudspeaker or sound amplifier at a level | |
26 | - | that does not exceed | |

27 | 25 | (2) at any time between the hours of 10 a.m. and 2 a.m. | |
28 | 26 | SECTION 3. This Act takes effect September 1, 2021. |
