97 relating to the authority of certain municipalities to impose
108 regulations on amplified sound from certain venues.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. This Act may be cited as the Entertainment and
1311 Hospitality Revitalization Act of 2021.
1412 SECTION 2. Chapter 217, Local Government Code, is amended
1513 by adding Subchapter Z to read as follows:
1614 SUBCHAPTER Z. MISCELLANEOUS PROVISIONS
1715 Sec. 217.901. REGULATION OF SOUND FROM CERTAIN VENUES IN
1816 CERTAIN MUNICIPALITIES PROHIBITED. (a) This section applies only
1917 to a municipality with a population of 750,000 or more that is
2018 primarily located in a county with a population of 1.5 million or
2119 less.
2220 (b) A municipality may not adopt or enforce an ordinance
23- that regulates the production of amplified sound from a bar if the
24- sound is produced:
21+ that regulates the production of amplified sound from a bar or live
22+ music venue located in a residential area if the sound is produced:
2523 (1) from a loudspeaker or sound amplifier at a level
26- that does not exceed 85 decibels; and
24+ that does not exceed 75 decibels; and
2725 (2) at any time between the hours of 10 a.m. and 2 a.m.
2826 SECTION 3. This Act takes effect September 1, 2021.
