5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the display of emergency and other notices by a
8	8	governmental entity on the entity's Internet website.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. (a) This section takes effect only if the Act of
11	11	the 87th Legislature, Regular Session, 2021, relating to
12	12	nonsubstantive additions to and corrections in enacted codes
13	13	becomes law.
14	14	(b) Subchapter E, Chapter 2051, Government Code, as added by
15	15	Chapter 1029 (H.B. 305), Acts of the 86th Legislature, Regular
16	16	Session, 2019, is redesignated as Subchapter F, Chapter 2051,
17	17	Government Code, and amended by adding Section 2051.203 to read as
18	18	follows:
19	19	Sec. 2051.203. REQUIRED POSTING OF NOTICE. (a) In this
20	20	section "governmental entity" has the meaning assigned by Section
21	21	2051.041.
22	22	(b) A governmental entity shall post in a prominent location
23	23	on the home page of the entity's Internet website:
24	24	(1) each emergency notification issued by the entity;
25	25	and
26	26	(2) any other official notice issued by the entity,
27	27	including notices regarding the entity's ability or inability to
28	28	provide services the entity normally provides to the public.
29	29	SECTION 2. (a) This section takes effect only if the Act of
30	30	the 87th Legislature, Regular Session, 2021, relating to
31	31	nonsubstantive additions to and corrections in enacted codes does
32	32	not become law.
33	33	(b) Subchapter E, Chapter 2051, Government Code, as added by
34	34	Chapter 1029 (H.B. 305), Acts of the 86th Legislature, Regular
35	35	Session, 2019, is amended by adding Section 2051.153 to read as
36	36	follows:
37	37	Sec. 2051.153. REQUIRED POSTING OF NOTICE. (a) In this
38	38	section "governmental entity" has the meaning assigned by Section
39	39	2051.041.
40	40	(b) A governmental entity shall post in a prominent location

48	48	the 87th Legislature, Regular Session, 2021, relating to
49	49	nonsubstantive additions to and corrections in enacted codes
50	50	becomes law.
51	51	(b) Section 2051.151, Government Code, as added by Chapter
52	52	1029 (H.B. 305), Acts of the 86th Legislature, Regular Session,
53	53	2019, is redesignated as Section 2051.201, Government Code, and
54	54	amended to read as follows:
55	55	Sec. 2051.201 [2051.151]. APPLICABILITY OF SUBCHAPTER.
56	56	Except as provided by Sections 2051.202(b) and 2051.203 [Section
57	57	2051.152(b)], this subchapter applies only to a political
58	58	subdivision with the authority to impose a tax that at any time on
59	59	or after January 1, 2019, maintained a publicly accessible Internet
60	60	website.
61	61	SECTION 4. (a) This section takes effect only if the Act of
62	62	the 87th Legislature, Regular Session, 2021, relating to
63	63	nonsubstantive additions to and corrections in enacted codes does
64	64	not become law.
65	65	(b) Section 2051.151, Government Code, as added by Chapter
66	66	1029 (H.B. 305), Acts of the 86th Legislature, Regular Session,
67	67	2019, is amended to read as follows:
68	68	Sec. 2051.151. APPLICABILITY OF SUBCHAPTER. Except as
69	69	provided by Sections [Section] 2051.152(b) and 2051.153, this
70	70	subchapter applies only to a political subdivision with the
71	71	authority to impose a tax that at any time on or after January 1,
72	72	2019, maintained a publicly accessible Internet website.
73	73	SECTION 5. This Act takes effect September 1, 2021.
