66 AN ACT
77 relating to the weather emergency preparedness of gas facilities
88 and facilities for providing electric service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 86, Natural Resources
1111 Code, is amended by adding Section 86.044 to read as follows:
1212 Sec. 86.044. WEATHER EMERGENCY PREPAREDNESS. (a) The
1313 commission by rule shall require an operator of a gas well to
1414 implement measures to prepare the well to operate during a weather
1515 emergency.
1616 (b) The rules must be based on information from the National
1717 Weather Service and the Office of the Texas State Climatologist
1818 about:
1919 (1) historic weather emergencies;
2020 (2) climate variability; and
2121 (3) projected changes in weather.
2222 (c) The commission shall review and, if necessary, update
2323 rules adopted under this section at least once every five years to
2424 account for changes in the information described by Subsection (b).
2525 (d) The rules must:
2626 (1) require an operator of a gas well to implement the
2727 required measures at the expense of the provider; and
2828 (2) require the provider to submit to the commission
2929 an annual report that shows the costs of implementing the required
3030 measures and that the costs were paid out of the operator's net
3131 profits.
3232 SECTION 2. Subchapter A, Chapter 35, Utilities Code, is
3333 amended by adding Section 35.0021 to read as follows:
3434 Sec. 35.0021. WEATHER EMERGENCY PREPAREDNESS. (a) The
3535 commission by rule shall require each provider of generation in the
3636 ERCOT power region to implement measures to prepare generation
3737 facilities to provide adequate electric generation service during a
3838 weather emergency.
3939 (b) The rules must be based on information from the National
4040 Weather Service and the Office of the Texas State Climatologist
4141 about:
4242 (1) historic weather emergencies;
4343 (2) climate variability; and
4444 (3) projected changes in weather.
4545 (c) The commission shall review and update rules adopted
4646 under this section at least once every five years to account for
4747 changes in the information described by Subsection (b).
4848 (d) The rules must:
4949 (1) require a provider of generation to implement the
5050 required measures at the expense of the provider; and
5151 (2) require the provider to submit to the commission
5252 an annual report that shows the costs of implementing the required
5353 measures and that the costs were paid out of the provider's net
5454 profits.
5555 SECTION 3. Subchapter D, Chapter 38, Utilities Code, is
5656 amended by adding Section 38.074 to read as follows:
5757 Sec. 38.074. WEATHER EMERGENCY PREPAREDNESS. (a) The
5858 commission by rule shall require each electric cooperative,
5959 municipally owned utility, and transmission and distribution
6060 utility providing transmission or distribution service in the ERCOT
6161 power region to implement measures to prepare facilities to
6262 maintain service quality and reliability during a weather
6363 emergency.
6464 (b) The rules must be based on information from the National
6565 Weather Service and the Office of the Texas State Climatologist
6666 about:
6767 (1) historic weather emergencies;
6868 (2) climate variability; and
6969 (3) projected changes in weather.
7070 (c) The commission shall review and update rules adopted
7171 under this section at least once every five years to account for
7272 changes in the information described by Subsection (b).
7373 (d) The commission shall conduct a study on possible ways to
7474 provide funding for the measures required by the rules for
7575 transmission and distribution utilities so that the cost of the
7676 measures is not paid by retail customers. The commission shall
7777 submit the results of the study to the legislature not later than
7878 September 1, 2022. This subsection expires September 1, 2023.
7979 SECTION 4. Section 121.2015, Utilities Code, is amended by
8080 amending Subsection (a) and adding Subsections (d), (e), and (f) to
8181 read as follows:
8282 (a) The railroad commission shall adopt rules regarding:
8383 (1) public education and awareness relating to gas
8484 pipeline facilities; [and]
8585 (2) community liaison for responding to an emergency
8686 relating to a gas pipeline facility; and
8787 (3) measures gas pipeline facility operators must
8888 implement to prepare gas pipeline facilities to maintain service
8989 quality and reliability during a weather emergency.
9090 (d) The rules adopted under Subsection (a)(3) must be based
9191 on information from the National Weather Service and the Office of
9292 the Texas State Climatologist about:
9393 (1) historic weather emergencies;
9494 (2) climate variability; and
9595 (3) projected changes in weather.
9696 (e) The commission shall review and, if necessary, update
9797 rules adopted under Subsection (a)(3) at least once every five
9898 years to account for changes in the information described by
9999 Subsection (d).
100100 (f) The commission shall conduct a study on possible ways to
101101 provide funding for the measures required by the rules adopted
102102 under Subsection (a)(3) so that the cost of the measures is not paid
103103 by retail customers. The commission shall submit the results of the
104104 study to the legislature not later than September 1, 2022. This
105105 subsection expires September 1, 2023.
106106 SECTION 5. The Public Utility Commission of Texas and the
107107 Railroad Commission of Texas shall adopt the rules required by this
108108 Act not later than January 1, 2022.
109109 SECTION 6. This Act takes effect immediately if it receives
110110 a vote of two-thirds of all the members elected to each house, as
111111 provided by Section 39, Article III, Texas Constitution. If this
112112 Act does not receive the vote necessary for immediate effect, this
113113 Act takes effect September 1, 2021.
