11+ A BILL TO BE ENTITLED
412 AN ACT
513 relating to the establishment of the State Advisory Council on
614 Educational Opportunity for Military Children.
715 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
816 SECTION 1. Section 162.001, Education Code, is amended by
917 adding Subdivision (3) to read as follows:
1018 (3) "State Advisory Council" means the State Advisory
1119 Council on Educational Opportunity for Military Children
1220 established under Section 162.006.
1321 SECTION 2. Chapter 162, Education Code, is amended by
1422 adding Section 162.006 to read as follows:
1523 Sec. 162.006. STATE ADVISORY COUNCIL AND COORDINATION. (a)
1624 The compact commissioner, in coordination with the Texas Education
1725 Agency, shall establish the State Advisory Council on Educational
1826 Opportunity for Military Children to provide for coordination among
1927 state agencies, school districts, and military installations
2028 concerning the state's participation in and compliance with the
2129 compact and compact activities, as required by Article VIII of the
2230 compact.
2331 (b) The State Advisory Council consists of:
2432 (1) the commissioner of education or the
2533 commissioner's designee;
2634 (2) a superintendent of a school district with a high
2735 concentration of military children designated by the agency;
2836 (3) the governor or the governor's designee;
2937 (4) the chair of the senate committee on education or
3038 the chair's designee;
3139 (5) the chair of the house of representatives
3240 committee on public education or the chair's designee;
3341 (6) a representative from each branch of the armed
3442 services of the United States that maintains an installation in the
3543 state, appointed by each respective branch; and
3644 (7) representatives of other offices and stakeholder
3745 groups the agency deems appropriate.
3846 (c) Members of the State Advisory Council may delegate
3947 voting authority to another person for a specified meeting or
4048 meetings.
4149 (d) Meetings of the State Advisory Council may be conducted
4250 face-to-face or by telephone or other means of telecommunication or
4351 electronic communication.
4452 (e) The State Advisory Council shall:
4553 (1) meet at least quarterly; and
4654 (2) provide State Advisory Council meeting dates,
4755 agendas, minutes, end-of-year reports, and other documentation as
4856 required to the Military Interstate Children's Compact Commission.
4957 (f) The State Advisory Council shall perform each function
5058 or duty required or authorized under Article VIII of the compact.
5159 (g) The State Advisory Council shall establish policies and
5260 procedures governing the State Advisory Council's operations.
5361 (h) The State Advisory Council is a governmental body for
5462 purposes of Chapter 551, Government Code.
5563 SECTION 3. Section 162.005, Education Code, is repealed.
5664 SECTION 4. This Act takes effect September 1, 2021.
