9	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	13		SECTION 1. Subchapter B, Chapter 202, Transportation Code,
11	14		is amended by adding Section 202.034 to read as follows:
12		-	Sec. 202.034. SALE OF ~~CERTAIN~~ STATE ~~HIGHWAYS ABUTTING PORT~~
13		-	~~OF ENTRY AT INTERNATIONAL BRIDGE~~. (a) Notwithstanding ~~any other~~
14		-	~~law, the department~~ may enter into an agreement to sell a portion of
15		-	~~a state highway~~ that abuts ~~a privately owned~~ port ~~of entry at an~~
16		-	~~international bridge to the owner or~~ operator of the port ~~of entry~~.
	15	+	Sec. 202.034. SALE OF STATE HIGHWAY TO AIRPORT, INLAND
	16	+	PORT, OR SEAPORT. (a) Notwithstanding other law, the department
	17	+	may enter into an agreement to sell a portion of a state highway
	18	+	that abuts an airport, inland port, or seaport to the owner or
	19	+	operator of the airport, inland port, or seaport.
17	20		(b) An agreement to sell real property under this section
18	21		must provide for assumption of responsibility for maintenance of
19	22		the property by the entity that acquires the property.
20	23		(c) The commission:
21	24		(1) shall determine the fair value of the state's
22	25		interest in real property to be sold under this section; and
23	26		(2) may authorize the executive director to execute a
24	27		deed conveying the state's interest in the property.
25	28		(d) The department may not sell the state's interest in the
26	29		real property for an amount less than the amount determined under
27	30		Subsection (c)(1).
28	31		(e) Revenue from the sale of property under this section
29	32		shall be deposited to the credit of the state highway fund.
30	33		SECTION 2. This Act takes effect immediately if it receives
31	34		a vote of two-thirds of all the members elected to each house, as
32	35		provided by Section 39, Article III, Texas Constitution. If this
33	36		Act does not receive the vote necessary for immediate effect, this
34	37		Act takes effect September 1, 2021.
