412 AN ACT
513 relating to required posting of information regarding the office of
614 the state long-term care ombudsman on certain long-term care
715 facilities' Internet websites.
816 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
917 SECTION 1. Subtitle B, Title 4, Health and Safety Code, is
1018 amended by adding Chapter 260C to read as follows:
1119 CHAPTER 260C. POSTING OF OFFICE OF STATE LONG-TERM CARE OMBUDSMAN
1220 INFORMATION BY CERTAIN FACILITIES
1321 Sec. 260C.001. DEFINITION. In this chapter, "long-term
1422 care facility" means:
1523 (1) a nursing facility licensed under Chapter 242;
1624 (2) an assisted living facility licensed under Chapter
1725 247; or
1826 (3) any other facility providing care to residents who
1927 are assisted by the state long-term care ombudsman established
2028 under Subchapter F, Chapter 101A, Human Resources Code.
2129 Sec. 260C.002. POSTING OF OFFICE OF STATE LONG-TERM CARE
2230 OMBUDSMAN INFORMATION ON INTERNET WEBSITE. (a) Except as provided
2331 by Subsection (b), a long-term care facility shall post on the
2432 facility's Internet website information about the office of the
2533 state long-term care ombudsman established under Subchapter F,
2634 Chapter 101A, Human Resources Code, including:
2735 (1) information regarding the office's role as an
2836 advocate for residents of long-term care facilities; and
2937 (2) the office's statewide toll-free telephone number.
3038 (b) A long-term care facility:
3139 (1) may comply with this section by posting the
3240 required information on the Internet website of the facility's
3341 parent company if the facility does not maintain a unique Internet
3442 website; and
3543 (2) is not required to comply with this section if the
3644 facility and any parent company do not maintain an Internet
3745 website.
3846 SECTION 2. This Act takes effect January 1, 2022.
