9- relating to consideration by an insurer of certain insurers' filed
6+ relating to consideration by an insurer of other insurers' filed
107 rates and factors in setting the insurer's rates.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Section 2251.052, Insurance Code, is amended by
13- adding Subsections (f), (g), and (h) to read as follows:
14- (f) Notwithstanding Section 1953.051(a), in setting rates,
15- an insurer writing personal or commercial automobile insurance may
16- include in a filing made under this chapter any rating rule, rate
17- variable, or rate classification that a county mutual insurance
18- company has filed and implemented under this chapter.
19- (g) An insurer that files a rating rule, rate variable, or
20- rate classification under Subsection (f) shall:
21- (1) indicate in the insurer's rate filing that the
22- insurer is filing the rating rule, rate variable, or rate
23- classification under Subsection (f); and
24- (2) reflect any cost savings realized by filing the
25- rating rule, rate variable, or rate classification under Subsection
26- (f) in the insurer's filing.
27- (h) Subsections (f) and (g) may not be construed to affect
28- any law relating to the confidentiality or public disclosure of
29- rate filings or of the department's review of rate filings.
30- SECTION 2. Sections 2251.052(f), (g), and (h), Insurance
31- Code, as added by this Act, apply only to a rate filed with the
32- commissioner of insurance under Chapter 2251, Insurance Code, on or
33- after the effective date of this Act.
10+ adding Subsection (f) to read as follows:
11+ (f) Notwithstanding any other provision of this code, in
12+ setting rates, an insurer may include in a filing made under this
13+ chapter any rating rule, rate variable, or rate classification that
14+ any other insurer has filed and implemented under this chapter.
15+ SECTION 2. Section 2251.052(f), Insurance Code, as added by
16+ this Act, applies only to a rate filed with the commissioner of
17+ insurance under Chapter 2251, Insurance Code, on or after the
18+ effective date of this Act.
3419 SECTION 3. This act takes effect September 1, 2021.
