55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a modernization plan for post-adjudication secure
88 correctional facilities operated by the Texas Juvenile Justice
99 Department and a task force to evaluate those facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 203, Human Resources Code, is amended by
1212 adding Section 203.020 to read as follows:
1313 Sec. 203.020. PLAN TO MODERNIZE SECURE FACILITIES. (a) In
1414 coordination with the regionalization plan described by Section
1515 203.017, the department shall develop and implement a plan to
1616 modernize the secure facilities operated by the department under
1717 Subtitle C.
1818 (b) The plan must:
1919 (1) provide for methods to:
2020 (A) reduce the department's deferred maintenance
2121 costs;
2222 (B) increase the energy efficiency of secure
2323 facilities;
2424 (C) direct cost savings to pay for health care
2525 costs for children committed to the department;
2626 (D) increase staffing efficiency; and
2727 (E) increase correctional staff compensation;
2828 (2) identify options for the department to contract
2929 with private sector vendors to build and maintain secure facilities
3030 to be leased by the department;
3131 (3) require new facilities to meet the standards for
3232 secure correctional facilities published by the American
3333 Correctional Association; and
3434 (4) require that new facilities be designed to:
3535 (A) maximize the safety of correctional
3636 officers, facility staff, and children committed to the custody of
3737 the department;
3838 (B) comply with any court-ordered remedy; and
3939 (C) facilitate the rehabilitation and
4040 reintegration into society of children committed to the custody of
4141 the department.
4242 (c) In developing the plan, the department shall consult
4343 with stakeholders and experts.
4444 (d) New facilities built under the plan may only be named
4545 for juvenile correctional officers or staff who:
4646 (1) were killed in the course of their employment with
4747 the department; or
4848 (2) made significant contributions to public safety in
4949 this state.
5050 SECTION 2. (a) A task force is established under this
5151 section to conduct a thorough evaluation of the Texas Juvenile
5252 Justice Department's secure correctional facilities.
5353 (b) The governor shall appoint to the task force in a number
5454 that the governor deems sufficient:
5555 (1) members of the house of representatives and
5656 senate;
5757 (2) local government officials; and
5858 (3) juvenile justice stakeholders.
5959 (c) Not later than September 1, 2022, the task force shall
6060 submit to the governor, the lieutenant governor, and the
6161 legislature recommendations regarding which secure correctional
6262 facilities operated by the Texas Juvenile Justice Department should
6363 be:
6464 (1) renovated and continued in operation as a secure
6565 correctional facility by the Texas Juvenile Justice Department;
6666 (2) renovated and used for a purpose other than a
6767 secure correctional facility by the Texas Juvenile Justice
6868 Department; or
6969 (3) repurposed by an entity other than the Texas
7070 Juvenile Justice Department.
7171 (d) The task force established under this section is
7272 abolished December 1, 2022.
7373 SECTION 3. Not later than January 1, 2022, the Texas
7474 Juvenile Justice Department shall develop the plan required by
7575 Section 203.020, Human Resources Code, as added by this Act.
7676 SECTION 4. As soon as practicable after the effective date
7777 of this Act, the governor shall make appointments to the task force
7878 created by this Act.
7979 SECTION 5. This Act takes effect September 1, 2021.
