| 10 | 10 | SECTION 1. Subchapter A, Chapter 48, Human Resources Code, | |
| 11 | 11 | is amended by adding Section 48.008 to read as follows: | |
| 12 | 12 | Sec. 48.008. PROVISION OF ASSISTANCE IN OBTAINING CERTAIN | |
| 13 | 13 | ORDERS. (a) In this section, "family violence" has the meaning | |
| 14 | 14 | assigned by Section 71.004, Family Code. | |
| 15 | 15 | (b) At the request of an elderly person and to exclude from | |
| 16 | 16 | the elderly person's residence an individual who has committed an | |
| 17 | 17 | act of physical or verbal abuse against the elderly person that is | |
| 18 | 18 | alleged to constitute family violence, the department shall provide | |
| 19 | 19 | assistance to the elderly person in obtaining a temporary ex parte | |
| 20 | 20 | order under Section 83.006, Family Code, to exclude the individual | |
| 21 | 21 | from the elderly person's residence. | |
| 22 | 22 | (c) The commissioner shall adopt rules as necessary to | |
| 23 | 23 | implement this section. | |
| 24 | 24 | SECTION 2. This Act takes effect September 1, 2021. |
