A BILL TO BE ENTITLED
AN ACT
relating to the provision of assistance to certain elderly persons
in obtaining certain protective orders.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 48, Human Resources Code,
is amended by adding Section 48.008 to read as follows:
Sec. 48.008. PROVISION OF ASSISTANCE IN OBTAINING CERTAIN
ORDERS. (a) In this section, "family violence" has the meaning
assigned by Section 71.004, Family Code.
(b) At the request of an elderly person and to exclude from
the elderly person's residence an individual who has committed an
act of physical or verbal abuse against the elderly person that is
alleged to constitute family violence, the department shall provide
assistance to the elderly person in obtaining a temporary ex parte
order under Section 83.006, Family Code, to exclude the individual
from the elderly person's residence.
(c) The commissioner shall adopt rules as necessary to
implement this section.
SECTION 2. This Act takes effect September 1, 2021.
