105 A BILL TO BE ENTITLED
116 AN ACT
127 relating to a study and report on the water level of Falcon Lake in
138 Zapata and Starr Counties.
149 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1510 SECTION 1. STUDY. The Parks and Wildlife Department and the
1611 Texas Commission on Environmental Quality shall jointly conduct a
1712 study on the water level of Falcon Lake in Zapata and Starr
1813 Counties. The study must:
1914 (1) evaluate the optimum water level for recreational
2015 fishing on the lake; and
2116 (2) examine the factors that contribute to or are
2217 affected by the rise and fall of the lake's water levels, including
2318 flood control, conservation, and hydroelectric power projects.
2419 SECTION 2. REPORT. Not later than December 1, 2022, the
2520 Parks and Wildlife Department and the Texas Commission on
2621 Environmental Quality shall submit to the governor, lieutenant
2722 governor, and speaker of the house of representatives a report that
2823 includes:
2924 (1) the findings of the study conducted under Section
3025 1 of this Act; and
3126 (2) recommendations to achieve and maintain the
3227 optimum water level for recreational fishing on Falcon Lake,
3328 consistent with the purpose of the lake's construction.
3429 SECTION 3. EXPIRATION DATE. This Act expires September 1,
3530 2023.
3631 SECTION 4. EFFECTIVE DATE. This Act takes effect
3732 immediately if it receives a vote of two-thirds of all the members
3833 elected to each house, as provided by Section 39, Article III, Texas
3934 Constitution. If this Act does not receive the vote necessary for
4035 immediate effect, this Act takes effect September 1, 2021.
