6 | 6 | | relating to Medicaid managed care accreditation. |

7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 533.0031, Government Code, is amended by |
---|
9 | 9 | | adding Subsection (c) to read as follows: |
---|
10 | 10 | | (c) The Commission may not award a managed care organization |
---|
11 | 11 | | a contract to provide services under the state's Medicaid Managed |
---|
12 | 12 | | Care Program unless that managed care organization has been |
---|
13 | 13 | | accredited or has initiated the process of becoming accredited by a |
---|
14 | 14 | | nationally recognized accrediting organization that: |
---|
15 | 15 | | (1) is required by no fewer than ten state Medicaid |
---|
16 | 16 | | programs as a sole accreditor; |
---|
17 | 17 | | (2) distinguishes managed care organizations for the |
---|
18 | 18 | | integration of long-term services and supports; and |
---|
19 | 19 | | (3) distinguishes managed care organizations for |
---|
20 | 20 | | their ability to provide culturally and linguistically sensitive |
---|
21 | 21 | | services, and work to reduce health care disparities. |

22 | 22 | | SECTION 2. Changes made by this Act apply only to a contract |
---|
23 | 23 | | awarded by the Health and Human Services Commission on or after the |
---|
24 | 24 | | effective date of this Act. |
---|
25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
---|
26 | 26 | | a vote of two-thirds of all members elected to each house, as |
---|
27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 29 | | Act takes effect September 1, 2021. |
