55 AN ACT
66 relating to Medicaid managed care accreditation.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 533.0031, Government Code, is amended by
99 adding Subsection (c) to read as follows:
1010 (c) The Commission may not award a managed care organization
1111 a contract to provide services under the state's Medicaid Managed
1212 Care Program unless that managed care organization has been
1313 accredited or has initiated the process of becoming accredited by a
1414 nationally recognized accrediting organization that:
1515 (1) is required by no fewer than ten state Medicaid
1616 programs as a sole accreditor;
1717 (2) distinguishes managed care organizations for the
1818 integration of long-term services and supports; and
1919 (3) distinguishes managed care organizations for
2020 their ability to provide culturally and linguistically sensitive
2121 services, and work to reduce health care disparities.
2222 SECTION 2. Changes made by this Act apply only to a contract
2323 awarded by the Health and Human Services Commission on or after the
2424 effective date of this Act.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2021.
