| 9 | 9 | SECTION 1. Subchapter D, Chapter 39, Utilities Code, is | |
| 10 | 10 | amended by adding Section 39.159 to read as follows: | |
| 11 | 11 | Sec. 39.159. TARGET RESERVE MARGIN FOR ERCOT POWER REGION. | |
| 12 | 12 | (a) The independent organization certified under Section 39.151 | |
| 13 | 13 | for the ERCOT power region must adopt a target planning reserve | |
| 14 | 14 | margin for ERCOT of not less than 15 percent of peak electric | |
| 15 | 15 | demand. | |
| 16 | 16 | (b) The commission shall adopt rules as necessary to achieve | |
| 17 | 17 | and enforce the minimum target planning reserve margin required | |
| 18 | 18 | under Subsection (a). | |
| 19 | 19 | SECTION 2. This Act takes effect September 1, 2021. |
