A BILL TO BE ENTITLED
AN ACT
relating to the target planning reserve margin for ERCOT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 39, Utilities Code, is
amended by adding Section 39.159 to read as follows:
Sec. 39.159. TARGET RESERVE MARGIN FOR ERCOT POWER REGION.
(a) The independent organization certified under Section 39.151
for the ERCOT power region must adopt a target planning reserve
margin for ERCOT of not less than 15 percent of peak electric
demand.
(b) The commission shall adopt rules as necessary to achieve
and enforce the minimum target planning reserve margin required
under Subsection (a).
SECTION 2. This Act takes effect September 1, 2021.
