| 5 | 12 | | relating to health benefit plan coverage for ovarian cancer testing |

| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 15 | | SECTION 1. Section 1370.003(b), Insurance Code, is amended |
|---|
| 9 | 16 | | to read as follows: |
|---|
| 10 | 17 | | (b) Coverage required under this section includes at a |
|---|
| 11 | 18 | | minimum: |
|---|
| 12 | 19 | | (1) a CA 125 blood test; [and] |
|---|
| 13 | 20 | | (2) a conventional Pap smear screening or a screening |
|---|
| 14 | 21 | | using liquid-based cytology methods, as approved by the United |
|---|
| 15 | 22 | | States Food and Drug Administration, alone or in combination with a |
|---|
| 16 | 23 | | test approved by the United States Food and Drug Administration for |
|---|
| 17 | 24 | | the detection of the human papillomavirus; and |
|---|
| 18 | 25 | | (3) any other test or screening approved by the United |
|---|
| 19 | 26 | | States Food and Drug Administration for the detection of ovarian |
|---|
| 20 | 27 | | cancer. |
|---|
| 21 | 28 | | SECTION 2. Section 1370.003, Insurance Code, as amended by |
|---|
| 22 | 29 | | this Act, applies only to a health benefit plan delivered, issued |
|---|
| 23 | 30 | | for delivery, or renewed on or after January 1, 2022. A health |
|---|
| 24 | 31 | | benefit plan delivered, issued for delivery, or renewed before |
|---|
| 25 | 32 | | January 1, 2022, is governed by the law as it existed immediately |
|---|
| 26 | 33 | | before the effective date of this Act, and that law is continued in |
|---|
| 27 | 34 | | effect for that purpose. |
|---|
| 28 | 35 | | SECTION 3. This Act takes effect September 1, 2021. |
