| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter H, Chapter 801, Occupations Code, is |
|---|
| 10 | 10 | | amended by adding Section 801.3525 to read as follows: |
|---|
| 11 | 11 | | Sec. 801.3525. PROHIBITION AGAINST INTERFERENCE WITH |
|---|
| 12 | 12 | | PRACTICE OF VETERINARY MEDICINE. (a) A veterinarian and the |
|---|
| 13 | 13 | | practice of veterinary medicine by the veterinarian are subject |
|---|
| 14 | 14 | | only to applicable federal law and regulations and applicable state |
|---|
| 15 | 15 | | law, including rules adopted by the board, that govern the practice |
|---|
| 16 | 16 | | of veterinary medicine. |
|---|
| 17 | 17 | | (b) Unless expressly authorized by state law, the governing |
|---|
| 18 | 18 | | body of a municipality may not adopt or enforce any ordinance, rule, |
|---|
| 19 | 19 | | or regulation that prohibits a veterinarian from performing a |
|---|
| 20 | 20 | | medical procedure on an animal that is not prohibited by this |
|---|
| 21 | 21 | | chapter or other state law. |
|---|
| 22 | 22 | | (c) A municipal ordinance, rule, or regulation that |
|---|
| 23 | 23 | | violates this section is void and unenforceable. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2021. |
