55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the reporting of certain instructional procedures
88 adopted by public schools due to the coronavirus disease pandemic.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 29, Education Code, is
1111 amended by adding Section 29.927 to read as follows:
1212 Sec. 29.927. REPORTING OF CERTAIN INFORMATION RELATED TO
1313 INSTRUCTIONAL PROCEDURES ADOPTED DUE TO CORONAVIRUS DISEASE
1414 (COVID-19) PANDEMIC; AGENCY REPORT. (a) The agency by rule shall
1515 require each school district and open-enrollment charter school to
1616 report on instructional procedures adopted by the district or
1717 school due to the coronavirus disease (COVID-19) pandemic,
1818 including the following information in the form and manner
1919 prescribed by the agency:
2020 (1) the level of student engagement in instruction
2121 since the onset of the coronavirus disease (COVID-19) pandemic,
2222 including:
2323 (A) the number of students who have been engaged
2424 in instruction during and after the 2020-2021 school year;
2525 (B) the number of students who were not engaged
2626 in instruction for a period of time during or after the 2020-2021
2727 school year but who, at the time of the report, are engaged in
2828 instruction;
2929 (C) the number of students who are not, at the
3030 time of the report, engaged in instruction; and
3131 (D) the number of students with whom, at the time
3232 of the report, the district or school has no contact;
3333 (2) the number of student disciplinary incidents,
3434 including the number of incidents related to:
3535 (A) a dress code or hairstyle violation;
3636 (B) possessing offensive visual material in a
3737 learning environment;
3838 (C) the required supervision or presence of an
3939 adult in a remote learning environment; and
4040 (D) a violation of the student code of conduct;
4141 and
4242 (3) information regarding student Internet access,
4343 including:
4444 (A) the number of students with access to
4545 broadband Internet;
4646 (B) the types of devices issued by the district
4747 or school that are used by students to access the Internet for
4848 learning and instruction;
4949 (C) the number of devices issued by the district
5050 or school to students to facilitate student Internet connectivity;
5151 (D) the cost to the district or school of
5252 providing and maintaining devices issued by the district or school
5353 for student Internet connectivity; and
5454 (E) any cost or charge paid by the student for the
5555 instructional use of a device issued to the student by the district
5656 or school for the student's Internet connectivity.
5757 (b) The information included in the report required by
5858 Subsection (a) must be disaggregated by:
5959 (1) student race, ethnicity, sex, socioeconomic
6060 status, and grade level, students enrolled in a special education
6161 program under Subchapter A, Chapter 29, students of limited English
6262 proficiency under Section 29.052, and students who are homeless;
6363 and
6464 (2) except for information required by Subsection
6565 (a)(3), the method by which instruction was offered, including if
6666 the instruction was offered:
6767 (A) in person;
6868 (B) remotely and synchronously; or
6969 (C) remotely and asynchronously.
7070 (c) The rules adopted under Subsection (a) must require a
7171 school district or open-enrollment charter school to submit the
7272 first report not later than December 1, 2021. A district or school
7373 must submit a report required by this section every 90 days.
7474 (d) The agency shall prepare and submit a report to the
7575 legislature based on the information collected under Subsection
7676 (a). The agency shall submit the first report required under this
7777 subsection not later than January 1, 2022. The agency must submit a
7878 report required by this section every 90 days.
7979 (e) This section expires September 1, 2024.
8080 SECTION 2. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2021.
