9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter Z, Chapter 29, Education Code, is |
---|
11 | 11 | | amended by adding Section 29.927 to read as follows: |
---|
12 | 12 | | Sec. 29.927. REPORTING OF CERTAIN INFORMATION RELATED TO |
---|
13 | 13 | | INSTRUCTIONAL PROCEDURES ADOPTED DUE TO CORONAVIRUS DISEASE |
---|
14 | 14 | | (COVID-19) PANDEMIC; AGENCY REPORT. (a) The agency by rule shall |
---|
15 | 15 | | require each school district and open-enrollment charter school to |
---|
16 | 16 | | report on instructional procedures adopted by the district or |
---|
17 | 17 | | school due to the coronavirus disease (COVID-19) pandemic, |
---|
18 | 18 | | including the following information in the form and manner |
---|
19 | 19 | | prescribed by the agency: |
---|
20 | 20 | | (1) the level of student engagement in instruction |
---|
21 | 21 | | since the onset of the coronavirus disease (COVID-19) pandemic, |
---|
22 | 22 | | including: |
---|
23 | 23 | | (A) the number of students who have been engaged |
---|
24 | 24 | | in instruction during and after the 2020-2021 school year; |
---|
25 | 25 | | (B) the number of students who were not engaged |
---|
26 | 26 | | in instruction for a period of time during or after the 2020-2021 |
---|
27 | 27 | | school year but who, at the time of the report, are engaged in |
---|
28 | 28 | | instruction; |
---|
29 | 29 | | (C) the number of students who are not, at the |
---|
30 | 30 | | time of the report, engaged in instruction; and |
---|
31 | 31 | | (D) the number of students with whom, at the time |
---|
32 | 32 | | of the report, the district or school has no contact; |
---|
33 | 33 | | (2) the number of student disciplinary incidents, |
---|
34 | 34 | | including the number of incidents related to: |
---|
35 | 35 | | (A) a dress code or hairstyle violation; |
---|
36 | 36 | | (B) possessing offensive visual material in a |
---|
37 | 37 | | learning environment; |
---|
38 | 38 | | (C) the required supervision or presence of an |
---|
39 | 39 | | adult in a remote learning environment; and |
---|
40 | 40 | | (D) a violation of the student code of conduct; |
---|
41 | 41 | | and |
---|
42 | 42 | | (3) information regarding student Internet access, |
---|
43 | 43 | | including: |
---|
44 | 44 | | (A) the number of students with access to |
---|
45 | 45 | | broadband Internet; |
---|
46 | 46 | | (B) the types of devices issued by the district |
---|
47 | 47 | | or school that are used by students to access the Internet for |
---|
48 | 48 | | learning and instruction; |
---|
49 | 49 | | (C) the number of devices issued by the district |
---|
50 | 50 | | or school to students to facilitate student Internet connectivity; |
---|
51 | 51 | | (D) the cost to the district or school of |
---|
52 | 52 | | providing and maintaining devices issued by the district or school |
---|
53 | 53 | | for student Internet connectivity; and |
---|
54 | 54 | | (E) any cost or charge paid by the student for the |
---|
55 | 55 | | instructional use of a device issued to the student by the district |
---|
56 | 56 | | or school for the student's Internet connectivity. |
---|
57 | 57 | | (b) The information included in the report required by |
---|
58 | 58 | | Subsection (a) must be disaggregated by: |
---|
59 | 59 | | (1) student race, ethnicity, sex, socioeconomic |
---|
60 | 60 | | status, and grade level, students enrolled in a special education |
---|
61 | 61 | | program under Subchapter A, Chapter 29, students of limited English |
---|
62 | 62 | | proficiency under Section 29.052, and students who are homeless; |
---|
63 | 63 | | and |
---|
64 | 64 | | (2) except for information required by Subsection |
---|
65 | 65 | | (a)(3), the method by which instruction was offered, including if |
---|
66 | 66 | | the instruction was offered: |
---|
67 | 67 | | (A) in person; |
---|
68 | 68 | | (B) remotely and synchronously; or |
---|
69 | 69 | | (C) remotely and asynchronously. |
---|
70 | 70 | | (c) The rules adopted under Subsection (a) must require a |
---|
71 | 71 | | school district or open-enrollment charter school to submit the |
---|
72 | 72 | | first report not later than December 1, 2021. A district or school |
---|
73 | 73 | | must submit a report required by this section every 90 days. |
---|
74 | 74 | | (d) The agency shall prepare and submit a report to the |
---|
75 | 75 | | legislature based on the information collected under Subsection |
---|
76 | 76 | | (a). The agency shall submit the first report required under this |
---|
77 | 77 | | subsection not later than January 1, 2022. The agency must submit a |
---|
78 | 78 | | report required by this section every 90 days. |
---|
79 | 79 | | (e) This section expires September 1, 2024. |
---|
80 | 80 | | SECTION 2. This Act takes effect immediately if it receives |
---|
81 | 81 | | a vote of two-thirds of all the members elected to each house, as |
---|
82 | 82 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
83 | 83 | | Act does not receive the vote necessary for immediate effect, this |
---|
84 | 84 | | Act takes effect September 1, 2021. |
