55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to civil liability and criminal penalties for performing
88 certain abortions; providing civil penalties; creating criminal
99 offenses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 71.002, Civil Practice and Remedies
1212 Code, is amended by adding Subsection (f) to read as follows:
1313 (f) A person is liable for damages arising from a violation
1414 of Section 170.002(a), 171.043, 171.044, 171.102, or 171.152,
1515 Health and Safety Code.
1616 SECTION 2. Section 71.004(b), Civil Practice and Remedies
1717 Code, is amended to read as follows:
1818 (b) The surviving spouse, children, and parents of the
1919 deceased may bring the action or one or more of those individuals
2020 may bring the action for the benefit of all. A next friend may bring
2121 an action for damages under Section 71.002(f).
2222 SECTION 3. Chapter 170, Health and Safety Code, is amended
2323 by adding Sections 170.003 and 170.004 to read as follows:
2424 Sec. 170.003. CRIMINAL PENALTY. (a) A person who violates
2525 Section 170.002(a) commits an offense.
2626 (b) An offense under this section is a felony of the second
2727 degree, except that the offense is a felony of the first degree if
2828 the person has previously been convicted of an offense under this
2929 section or under Section 171.049, 171.103, or 171.153.
3030 (c) If conduct constituting an offense under this section
3131 also constitutes an offense under another section of this code or
3232 the Penal Code, the actor may be prosecuted under this section or
3333 under both sections.
3434 Sec. 170.004. CIVIL PENALTY. (a) A person who violates
3535 Section 170.002(a) is liable to this state for a civil penalty of
3636 $30,000 for each violation.
3737 (b) The attorney general may sue to collect the penalty.
3838 (c) The attorney general shall file an action under this
3939 section in a district court in Travis County or the county in which
4040 the violation occurred.
4141 (d) The attorney general may recover reasonable expenses
4242 incurred in obtaining a civil penalty under this section, including
4343 court costs, attorney's fees, investigative costs, witness fees,
4444 and deposition expenses.
4545 SECTION 4. Subchapter C, Chapter 171, Health and Safety
4646 Code, is amended by adding Sections 171.049 and 171.050 to read as
4747 follows:
4848 Sec. 171.049. CRIMINAL PENALTY. (a) A person who violates
4949 Section 171.043 or 171.044 commits an offense.
5050 (b) An offense under this section is a felony of the second
5151 degree, except that the offense is a felony of the first degree if
5252 the person has previously been convicted of an offense under this
5353 section or under Section 170.003, 171.103, or 171.153.
5454 (c) If conduct constituting an offense under this section
5555 also constitutes an offense under another section of this code or
5656 the Penal Code, the actor may be prosecuted under this section or
5757 under both sections.
5858 Sec. 171.050. CIVIL PENALTY. (a) A person who violates
5959 Section 171.043 or 171.044 is liable to this state for a civil
6060 penalty of $30,000 for each violation.
6161 (b) The attorney general may sue to collect the penalty.
6262 (c) The attorney general shall file an action under this
6363 section in a district court in Travis County or the county in which
6464 the violation occurred.
6565 (d) The attorney general may recover reasonable expenses
6666 incurred in obtaining a civil penalty under this section, including
6767 court costs, attorney's fees, investigative costs, witness fees,
6868 and deposition expenses.
6969 SECTION 5. Section 171.103, Health and Safety Code, is
7070 amended to read as follows:
7171 Sec. 171.103. CRIMINAL PENALTY. (a) A person who violates
7272 Section 171.102 commits an offense.
7373 (b) An offense under this section is a felony of the second
7474 degree, except that the offense is a felony of the first degree if
7575 the person has previously been convicted of an offense under this
7676 section or under Section 170.003, 171.049, or 171.153 [state jail
7777 felony].
7878 (c) If conduct constituting an offense under this section
7979 also constitutes an offense under another section of this code or
8080 the Penal Code, the actor may be prosecuted under this section or
8181 under both sections.
8282 SECTION 6. Subchapter F, Chapter 171, Health and Safety
8383 Code, is amended by adding Section 171.1045 to read as follows:
8484 Sec. 171.1045. CIVIL PENALTY. (a) A person who violates
8585 Section 171.102 is liable to this state for a civil penalty of
8686 $30,000 for each violation.
8787 (b) The attorney general may sue to collect the penalty.
8888 (c) The attorney general shall file an action under this
8989 section in a district court in Travis County or the county in which
9090 the violation occurred.
9191 (d) The attorney general may recover reasonable expenses
9292 incurred in obtaining a civil penalty under this section, including
9393 court costs, attorney's fees, investigative costs, witness fees,
9494 and deposition expenses.
9595 SECTION 7. Section 171.153, Health and Safety Code, is
9696 amended by amending Subsection (b) and adding Subsection (c) to
9797 read as follows:
9898 (b) An offense under this section is a felony of the second
9999 degree, except that the offense is a felony of the first degree if
100100 the person has previously been convicted of an offense under this
101101 section or under Section 170.003, 171.049, or 171.103 [state jail
102102 felony].
103103 (c) If conduct constituting an offense under this section
104104 also constitutes an offense under another section of this code or
105105 the Penal Code, the actor may be prosecuted under this section or
106106 under both sections.
107107 SECTION 8. Subchapter G, Chapter 171, Health and Safety
108108 Code, is amended by adding Section 171.1535 to read as follows:
109109 Sec. 171.1535. CIVIL PENALTY. (a) A person who violates
110110 Section 171.152 is liable to this state for a civil penalty of
111111 $30,000 for each violation.
112112 (b) The attorney general may sue to collect the penalty.
113113 (c) The attorney general shall file an action under this
114114 section in a district court in Travis County or the county in which
115115 the violation occurred.
116116 (d) The attorney general may recover reasonable expenses
117117 incurred in obtaining a civil penalty under this section, including
118118 court costs, attorney's fees, investigative costs, witness fees,
119119 and deposition expenses.
120120 SECTION 9. The changes in law made by this Act apply only to
121121 a cause of action that accrues on or after the effective date of
122122 this Act. A cause of action that accrues before the effective date
123123 of this Act is governed by the law applicable to the cause of action
124124 immediately before that date, and that law is continued in effect
125125 for that purpose.
126126 SECTION 10. The changes in law made by this Act apply only
127127 to an abortion performed, induced, or attempted on or after the
128128 effective date of this Act. An abortion performed, induced, or
129129 attempted before the effective date of this Act is governed by the
130130 law in effect immediately before the effective date of this Act, and
131131 the former law is continued in effect for that purpose.
132132 SECTION 11. This Act takes effect September 1, 2021.
