9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 1202.004, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 1202.004. FEE FOR EXAMINATION BY ATTORNEY GENERAL. |
---|
13 | 13 | | (a) When an issuer submits a record of proceedings to the attorney |
---|
14 | 14 | | general for examination and approval as provided by law, the issuer |
---|
15 | 15 | | shall pay a nonrefundable examination fee to the attorney general |
---|
16 | 16 | | in accordance with this section. |
---|
17 | 17 | | (b) If the issuer is issuing multiple series or subseries of |
---|
18 | 18 | | a single public security issue, the issuer shall pay the fee |
---|
19 | 19 | | prescribed by this section for each series or subseries. |
---|
20 | 20 | | (c) Except as provided by Subsection (d) and (e), the |
---|
21 | 21 | | nonrefundable examination fee required by this section is equal to |
---|
22 | 22 | | the lesser of: |
---|
23 | 23 | | (1) one-tenth of one percent of the principal amount |
---|
24 | 24 | | of the public security to which the record of proceedings relates; |
---|
25 | 25 | | or |
---|
26 | 26 | | (2) $50,000 [$9,500]. |
---|
27 | 27 | | (d) The minimum examination fee required by this section is |
---|
28 | 28 | | $750. |
---|
29 | 29 | | (e) If the issuer is a non-profit corporation, the |
---|
30 | 30 | | nonrefundable examination fee required by this section is equal to |
---|
31 | 31 | | one-fourth of one percent of the principal amount of the public |
---|
32 | 32 | | security to which the record of proceedings relates. |
---|
33 | 33 | | (f) The attorney general may adopt rules necessary to |
---|
34 | 34 | | administer this section. |
---|
35 | 35 | | (g) Fees collected by the attorney general under this |
---|
36 | 36 | | section shall be deposited in the state treasury and expended as |
---|
37 | 37 | | provided in the general appropriations act. Fees collected in |
---|
38 | 38 | | excess of amounts provided in the general appropriations act may be |
---|
39 | 39 | | appropriated back to the attorney general for the purpose of |
---|
40 | 40 | | administering victim related services and sexual assault programs. |
---|
41 | 41 | | SECTION 2. The changes in law made by this Act apply only to |
---|
42 | 42 | | a bond approval submitted to the attorney general on or after the |
---|
43 | 43 | | effective date of this Act. A bond approval submitted to the |
---|
44 | 44 | | attorney general before the effective date of this Act is govnerend |
---|
45 | 45 | | by the law in effect on the date the bond was submitted, and the |
---|
46 | 46 | | former law is continued in effect for that purpose. |
---|
47 | 47 | | SECTION 3. This Act takes effect on September 1, 2021. |
