44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to examination fees for the review and approval of public
77 securities and related proceedings and funding for victims
88 assistance and sexual assault prevention services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1202.004, Government Code, is amended to
1111 read as follows:
1212 Sec. 1202.004. FEE FOR EXAMINATION BY ATTORNEY GENERAL.
1313 (a) When an issuer submits a record of proceedings to the attorney
1414 general for examination and approval as provided by law, the issuer
1515 shall pay a nonrefundable examination fee to the attorney general
1616 in accordance with this section.
1717 (b) If the issuer is issuing multiple series or subseries of
1818 a single public security issue, the issuer shall pay the fee
1919 prescribed by this section for each series or subseries.
2020 (c) Except as provided by Subsection (d) and (e), the
2121 nonrefundable examination fee required by this section is equal to
2222 the lesser of:
2323 (1) one-tenth of one percent of the principal amount
2424 of the public security to which the record of proceedings relates;
2525 or
2626 (2) $50,000 [$9,500].
2727 (d) The minimum examination fee required by this section is
2828 $750.
2929 (e) If the issuer is a non-profit corporation, the
3030 nonrefundable examination fee required by this section is equal to
3131 one-fourth of one percent of the principal amount of the public
3232 security to which the record of proceedings relates.
3333 (f) The attorney general may adopt rules necessary to
3434 administer this section.
3535 (g) Fees collected by the attorney general under this
3636 section shall be deposited in the state treasury and expended as
3737 provided in the general appropriations act. Fees collected in
3838 excess of amounts provided in the general appropriations act may be
3939 appropriated back to the attorney general for the purpose of
4040 administering victim related services and sexual assault programs.
4141 SECTION 2. The changes in law made by this Act apply only to
4242 a bond approval submitted to the attorney general on or after the
4343 effective date of this Act. A bond approval submitted to the
4444 attorney general before the effective date of this Act is govnerend
4545 by the law in effect on the date the bond was submitted, and the
4646 former law is continued in effect for that purpose.
4747 SECTION 3. This Act takes effect on September 1, 2021.
