55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to planning for equity of access to and safety and
88 diversity of transportation systems.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 201.601(a), (a-1), and (c),
1111 Transportation Code, are amended to read as follows:
1212 (a) The department shall develop a statewide transportation
1313 plan covering a period of 24 years that contains safe options for
1414 all modes of transportation, including:
1515 (1) walking, by pedestrians of all ages and abilities;
1616 (2) bicycling;
1717 (3) highways and turnpikes;
1818 (4) [(2)] aviation;
1919 (5) [(3)] mass transportation;
2020 (6) [(4)] railroads and high-speed railroads; and
2121 (7) [(5)] water traffic.
2222 (a-1) The plan must:
2323 (1) contain specific and clearly defined
2424 transportation system strategies, long-term transportation goals
2525 for the state and measurable targets for each goal, and other
2626 related performance measures;
2727 (2) identify priority corridors, projects, or areas of
2828 the state that are of particular concern to the department in
2929 meeting the goals established under Subdivision (1); [and]
3030 (3) contain a participation plan specifying methods
3131 for obtaining formal input on the goals and priorities identified
3232 under this subsection from:
3333 (A) other state agencies;
3434 (B) political subdivisions;
3535 (C) local transportation entities; and
3636 (D) the general public;
3737 (4) use methodologies to plan for equitable access to
3838 transportation systems by all area residents; and
3939 (5) consider alternative design and investment
4040 options, alternative growth forecasts, and robust alternative
4141 travel demand models that will ensure equity among the area's
4242 residents.
4343 (c) The plan must include a component that is not
4444 financially constrained and identifies transportation improvements
4545 designed to relieve congestion, end traffic deaths, and increase
4646 safe and fast transportation access by all modes of
4747 transportation. In developing this component of the plan, the
4848 department shall seek opinions and assistance from officials who
4949 have local responsibility for modes of transportation listed in
5050 Subsection (a).
5151 SECTION 2. Section 201.620, Transportation Code, is amended
5252 to read as follows:
5353 Sec. 201.620. COORDINATION WITH METROPOLITAN PLANNING
5454 ORGANIZATIONS TO DEVELOP LONG-TERM PLANNING ASSUMPTIONS. (a) The
5555 department shall collaborate with metropolitan planning
5656 organizations to develop mutually acceptable assumptions for the
5757 purposes of long-range federal and state funding forecasts and use
5858 those assumptions to guide long-term planning in the statewide
5959 transportation plan under Section 201.601.
6060 (b) The assumptions under Subsection (a) must be developed:
6161 (1) through a public process;
6262 (2) using methodologies to plan for equitable access
6363 to transportation systems by all area residents; and
6464 (3) using a range of reasonable alternative future
6565 population and job growth scenarios and travel demand models.
6666 SECTION 3. This Act takes effect September 1, 2021.
