8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
9 | 15 | | SECTION 1. Subtitle K, Title 2, Government Code, is amended |
---|
10 | 16 | | by adding Chapter 130 to read as follows: |
---|
11 | 17 | | CHAPTER 130. JUVENILE FAMILY DRUG COURT PROGRAM |
---|
12 | 18 | | Sec. 130.001. JUVENILE FAMILY DRUG COURT PROGRAM |
---|
13 | 19 | | DEFINED. In this chapter, "juvenile family drug court program" |
---|
14 | 20 | | means a program that has the following essential characteristics: |
---|
15 | 21 | | (1) the integration of substance abuse treatment |
---|
16 | 22 | | services in the processing of cases and proceedings under Title 3, |
---|
17 | 23 | | Family Code; |
---|
18 | 24 | | (2) the use of a comprehensive case management |
---|
19 | 25 | | approach involving court-appointed case managers and |
---|
20 | 26 | | court-appointed special advocates to rehabilitate an individual |
---|
21 | 27 | | who is suspected of substance abuse and who resides with a child who |
---|
22 | 28 | | is the subject of a case filed under Title 3, Family Code; |
---|
23 | 29 | | (3) early identification and prompt placement of |
---|
24 | 30 | | eligible individuals who volunteer to participate in the program; |
---|
25 | 31 | | (4) comprehensive substance abuse needs assessment |
---|
26 | 32 | | and referrals to appropriate substance abuse treatment agencies for |
---|
27 | 33 | | participants; |
---|
28 | 34 | | (5) a progressive treatment approach with specific |
---|
29 | 35 | | requirements for participants to meet for successful completion of |
---|
30 | 36 | | the program; |
---|
31 | 37 | | (6) monitoring of abstinence through periodic |
---|
32 | 38 | | screening for alcohol or screening for controlled substances; |
---|
33 | 39 | | (7) ongoing judicial interaction with program |
---|
34 | 40 | | participants; |
---|
35 | 41 | | (8) monitoring and evaluation of program goals and |
---|
36 | 42 | | effectiveness; |
---|
37 | 43 | | (9) continuing interdisciplinary education for the |
---|
38 | 44 | | promotion of effective program planning, implementation, and |
---|
39 | 45 | | operation; and |
---|
40 | 46 | | (10) development of partnerships with public agencies |
---|
41 | 47 | | and community organizations. |
---|
42 | 48 | | Sec. 130.002. AUTHORITY TO ESTABLISH PROGRAM. The |
---|
43 | 49 | | commissioners court of a county may establish a juvenile family |
---|
44 | 50 | | drug court program for individuals who: |
---|
45 | 51 | | (1) are suspected by the Department of Family and |
---|
46 | 52 | | Protective Services or the court of having a substance abuse |
---|
47 | 53 | | problem; and |
---|
48 | 54 | | (2) reside in the home of a child who is the subject of |
---|
49 | 55 | | a case filed under Title 3, Family Code. |
---|
50 | 56 | | Sec. 130.003. PARTICIPANT PAYMENT FOR TREATMENT AND |
---|
51 | 57 | | SERVICES. A juvenile family drug court program may require a |
---|
52 | 58 | | participant to pay the cost of all treatment and services received |
---|
53 | 59 | | while participating in the program, based on the participant's |
---|
54 | 60 | | ability to pay. |
---|
55 | 61 | | Sec. 130.004. FUNDING. A county that creates a juvenile |
---|
56 | 62 | | family drug court under this chapter shall explore the possibility |
---|
57 | 63 | | of using court improvement project money to finance the juvenile |
---|
58 | 64 | | family drug court in the county. The county also shall explore the |
---|
59 | 65 | | availability of federal and state matching money to finance the |
---|
60 | 66 | | court. |
---|
61 | 67 | | SECTION 2. This Act takes effect September 1, 2021. |
