118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Section 8843.056(c), Special District Local Laws
1310 Code, is amended to read as follows:
1411 (c) At the first election after the single-member districts
1512 are revised, a new director shall be elected from each district. The

18+ Sec. 8843.104. EXEMPT WELLS. (a) In this section,
19+ "existing well" means a well in the district that was completed on
20+ or before September 1, 2001.
21+ (a-1) The district may not require a permit to operate an
22+ existing well used for [Groundwater withdrawals from the following
23+ wells may not be regulated, permitted, or metered by the district]:
24+ (1) [a well used for] domestic use by a single-family
25+ [single private] residential household that is [and] incapable of
26+ producing more than 25,000 gallons of groundwater per day; or [and]
27+ (2) [a well used for] agricultural use [conventional
28+ farming and ranching activities, including such intensive
29+ operations as aquaculture, livestock feedlots, or poultry
30+ operations].
31+ (b) The district may not require a meter on [charge or
32+ collect a well construction fee for] a well described by Subsection
33+ (a-1)(1) [(a)(2)].
34+ (b-1) A well owner must obtain a permit and pay any required
35+ fees, including a well construction fee, before using any
36+ groundwater withdrawn from a well in the district for purposes
37+ other than those exempted by this chapter or Chapter 36, Water Code
38+ [section].
39+ (c) The owner of a [A] well used for commercial agricultural
40+ irrigation use shall:
41+ (1) register the well with the district;
42+ (2) install a meter that meets district standards for
43+ accuracy; and
44+ (3) annually report the total amount of groundwater
45+ production from the well on a form approved [dewatering and
46+ monitoring in the production of coal or lignite is exempt from
47+ permit requirements, regulations, and fees imposed] by the
48+ district.
49+ (d) The district may not enter property to inspect a [an
50+ exempt] well described by Subsection (a-1)(1) without the property
51+ owner's permission.
52+ SECTION 3. Section 8843.152, Special District Local Laws
53+ Code, is amended by amending Subsection (b) and adding Subsection
54+ (c) to read as follows:
55+ (b) The district may assess [levy and collect] a water
56+ utility service connection fee only in accordance with the
57+ following schedule and Subsection (c) based on the size of the meter

78+ SECTION 4. Section 8843.153, Special District Local Laws

80+ Sec. 8843.153. TAXES [AND OTHER FEES] PROHIBITED.
81+ Notwithstanding Section 8843.101 or Subchapter G, Chapter 36, Water
82+ Code, the district may not[:
83+ [(1)] impose a tax[; or
84+ [(2) assess or collect any fees except as authorized
85+ by Section 8843.151 or 8843.152].
86+ SECTION 5. Subchapter D, Chapter 8843, Special District
87+ Local Laws Code, is amended by adding Section 8843.155 to read as
88+ follows:
89+ Sec. 8843.155. FEES. (a) The district may assess
90+ production fees as authorized by Section 36.205, Water Code. The
91+ district may not assess production fees for water used for
92+ agricultural use.
93+ (b) The district may not charge for an annual period a
94+ production fee greater than 25 cents per 1,000 gallons authorized
95+ to be withdrawn under a permit issued by the district.
96+ SECTION 6. The following sections of the Special District
97+ Local Laws Code are repealed:
98+ (1) Section 8843.055;
99+ (2) Section 8843.105; and
100+ (3) Section 8843.106.
101+ SECTION 7. This Act takes effect September 1, 2021.
