5	7		A BILL TO BE ENTITLED
6	8		AN ACT
7	9		relating to the territory of the Horizon Regional Municipal Utility
8	10		District.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Chapter 32, Acts of the 57th Legislature, 1st
11	13		Called Session, 1961, is amended by adding Section 2A to read as
12	14		follows:
13	15		Sec. 2A. (a) In this section:
14	16		(1) "Area" means the area described by Subsection (c)
15	17		of this section.
16	18		(2) "District" means the Horizon Regional Municipal
17	19		Utility District.
18	20		(b) The inclusion of the area into the territory of the
19	21		district is contingent on an election being held within the area and
20	22		the successful passage of a proposition on the question of:
21	23		(1) inclusion of the area in the district;
22	24		(2) authorizing the assumption by the area of a
23	25		proportional part of the bonds, notes, obligations, and taxes of
24	26		the district outstanding at the time of the election; and
25	27		(3) authorizing the assumption by the area of a
26	28		proportional part of the bonds payable wholly or partly by taxes
27	29		that have been previously approved but not yet issued or sold by
28	30		the district and the imposition of a tax on all taxable property
29	31		within the area along with a tax on the rest of the district for
30	32		payment of those bonds.
31	33		(c) The following area may be included in the district as
32	34		described by Subsection (b) of this section:
33	35		"TRUE POINT OF BEGINNING" being a found 1" iron rod held for the
34	36		common corner of Sections 39, 38,46, and 47, Block 78, Township 3,
35	37		Texas and Pacific Railway Company Surveys and having Texas State
36	38		Plane Coordinates N=10,617,593.31, E=493,881.12.
37	39		Thence, South 02'25°56" West a distance of 1,318.09 feet to a
38	40		point;
39	41		Thence, North 87'00°52" West a distance of 1,315.55 feet to a
40	42		found 5/8"" rebar;
41	43		Thence, North 02'25°56" East a distance of 1,318.04 feet to a
42	44		found 1/2" rebar with cap "2998";
43	45		Thence, South 87'00°59" East a distance of 1315.55 feet to
44	46		"TRUE POINT OF BEGINNING" and containing in all 1,733,899 square
45	47		feet or 39.8048 acres of land more or less.
46	48		SECTION 2. (a) The legal notice of the intention to
47	49		introduce this Act, setting forth the general substance of this
48	50		Act, has been published as provided by law, and the notice and a
49	51		copy of this Act have been furnished to all persons, agencies,
50	52		officials, or entities to which they are required to be furnished
51	53		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
52	54		Government Code.
53	55		(b) The governor, one of the required recipients, has
54	56		submitted the notice and Act to the Texas Commission on
55	57		Environmental Quality.
56	58		(c) The Texas Commission on Environmental Quality has filed
57	59		its recommendations relating to this Act with the governor, the
58	60		lieutenant governor, and the speaker of the house of
59	61		representatives within the required time.
60	62		(d) All requirements of the constitution and laws of this
61	63		state and the rules and procedures of the legislature with respect
62	64		to the notice, introduction, and passage of this Act are fulfilled
63	65		and accomplished.
64	66		SECTION 3. This Act takes effect immediately if it receives
65	67		a vote of two-thirds of all the members elected to each house, as
66	68		provided by Section 39, Article III, Texas Constitution. If this
67	69		Act does not receive the vote necessary for immediate effect, this
68	70		Act takes effect September 1, 2021.
