87R21688 SLB-D By: González of El Paso H.B. No. 4624 A BILL TO BE ENTITLED AN ACT relating to the territory of the Horizon Regional Municipal Utility District. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 32, Acts of the 57th Legislature, 1st Called Session, 1961, is amended by adding Section 2A to read as follows: Sec. 2A. (a) In this section: (1) "Area" means the area described by Subsection (c) of this section. (2) "District" means the Horizon Regional Municipal Utility District. (b) The inclusion of the area into the territory of the district is contingent on an election being held within the area and the successful passage of a proposition on the question of: (1) inclusion of the area in the district; (2) authorizing the assumption by the area of a proportional part of the bonds, notes, obligations, and taxes of the district outstanding at the time of the election; and (3) authorizing the assumption by the area of a proportional part of the bonds payable wholly or partly by taxes that have been previously approved but not yet issued or sold by the district and the imposition of a tax on all taxable property within the area along with a tax on the rest of the district for payment of those bonds. (c) The following area may be included in the district as described by Subsection (b) of this section: "TRUE POINT OF BEGINNING" being a found 1" iron rod held for the common corner of Sections 39, 38,46, and 47, Block 78, Township 3, Texas and Pacific Railway Company Surveys and having Texas State Plane Coordinates N=10,617,593.31, E=493,881.12. Thence, South 02'25°56" West a distance of 1,318.09 feet to a point; Thence, North 87'00°52" West a distance of 1,315.55 feet to a found 5/8"" rebar; Thence, North 02'25°56" East a distance of 1,318.04 feet to a found 1/2" rebar with cap "2998"; Thence, South 87'00°59" East a distance of 1315.55 feet to "TRUE POINT OF BEGINNING" and containing in all 1,733,899 square feet or 39.8048 acres of land more or less. SECTION 2. (a) The legal notice of the intention to introduce this Act, setting forth the general substance of this Act, has been published as provided by law, and the notice and a copy of this Act have been furnished to all persons, agencies, officials, or entities to which they are required to be furnished under Section 59, Article XVI, Texas Constitution, and Chapter 313, Government Code. (b) The governor, one of the required recipients, has submitted the notice and Act to the Texas Commission on Environmental Quality. (c) The Texas Commission on Environmental Quality has filed its recommendations relating to this Act with the governor, the lieutenant governor, and the speaker of the house of representatives within the required time. (d) All requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2021.
