412 AN ACT
513 relating to the creation of the Montgomery County Municipal Utility
614 District No. 203; granting a limited power of eminent domain;
715 providing authority to issue bonds; providing authority to impose
816 assessments, fees, and taxes.
917 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1018 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1119 Code, is amended by adding Chapter 7917A to read as follows:
1220 CHAPTER 7917A. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT

1422 SUBCHAPTER A. GENERAL PROVISIONS
1523 Sec. 7917A.0101. DEFINITIONS. In this chapter:
1624 (1) "Board" means the district's board of directors.
1725 (2) "Commission" means the Texas Commission on
1826 Environmental Quality.
1927 (3) "Director" means a board member.
2028 (4) "District" means the Montgomery County Municipal
2129 Utility District No. 203.
2230 Sec. 7917A.0102. NATURE OF DISTRICT. The district is a
2331 municipal utility district created under Section 59, Article XVI,
2432 Texas Constitution.
2533 Sec. 7917A.0103. CONFIRMATION AND DIRECTOR ELECTION
2634 REQUIRED. The temporary directors shall hold an election to
2735 confirm the creation of the district and to elect five permanent
2836 directors as provided by Section 49.102, Water Code.
2937 Sec. 7917A.0104. CONSENT OF MUNICIPALITY REQUIRED. The
3038 temporary directors may not hold an election under Section
3139 7917A.0103 until each municipality in whose corporate limits or
3240 extraterritorial jurisdiction the district is located has
3341 consented by ordinance or resolution to the creation of the
3442 district and to the inclusion of land in the district.
3543 Sec. 7917A.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3644 (a) The district is created to serve a public purpose and benefit.
3745 (b) The district is created to accomplish the purposes of:
3846 (1) a municipal utility district as provided by
3947 general law and Section 59, Article XVI, Texas Constitution; and
4048 (2) Section 52, Article III, Texas Constitution, that
4149 relate to the construction, acquisition, improvement, operation,
4250 or maintenance of macadamized, graveled, or paved roads, or
4351 improvements, including storm drainage, in aid of those roads.
4452 Sec. 7917A.0106. INITIAL DISTRICT TERRITORY. (a) The
4553 district is initially composed of the territory described by
4654 Section 2 of the Act enacting this chapter.
4755 (b) The boundaries and field notes contained in Section 2 of
4856 the Act enacting this chapter form a closure. A mistake made in the
4957 field notes or in copying the field notes in the legislative process
5058 does not affect the district's:
5159 (1) organization, existence, or validity;
5260 (2) right to issue any type of bond for the purposes
5361 for which the district is created or to pay the principal of and
5462 interest on a bond;
5563 (3) right to impose a tax; or
5664 (4) legality or operation.
5765 SUBCHAPTER B. BOARD OF DIRECTORS
5866 Sec. 7917A.0201. GOVERNING BODY; TERMS. (a) The district
5967 is governed by a board of five elected directors.
6068 (b) Except as provided by Section 7917A.0202, directors
6169 serve staggered four-year terms.
6270 Sec. 7917A.0202. TEMPORARY DIRECTORS. (a) On or after
6371 September 1, 2021, the owner or owners of a majority of the assessed
6472 value of the real property in the district may submit a petition to
6573 the commission requesting that the commission appoint as temporary
6674 directors the five persons named in the petition. The commission
6775 shall appoint as temporary directors the five persons named in the
6876 petition.
6977 (b) Temporary directors serve until the earlier of:
7078 (1) the date permanent directors are elected under
7179 Section 7917A.0103; or
7280 (2) September 1, 2025.
7381 (c) If permanent directors have not been elected under
7482 Section 7917A.0103 and the terms of the temporary directors have
7583 expired, successor temporary directors shall be appointed or
7684 reappointed as provided by Subsection (d) to serve terms that
7785 expire on the earlier of:
7886 (1) the date permanent directors are elected under
7987 Section 7917A.0103; or
8088 (2) the fourth anniversary of the date of the
8189 appointment or reappointment.
8290 (d) If Subsection (c) applies, the owner or owners of a
8391 majority of the assessed value of the real property in the district
8492 may submit a petition to the commission requesting that the
8593 commission appoint as successor temporary directors the five
8694 persons named in the petition. The commission shall appoint as
8795 successor temporary directors the five persons named in the
8896 petition.
8997 SUBCHAPTER C. POWERS AND DUTIES
9098 Sec. 7917A.0301. GENERAL POWERS AND DUTIES. The district
9199 has the powers and duties necessary to accomplish the purposes for
92100 which the district is created.
93101 Sec. 7917A.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
94102 DUTIES. The district has the powers and duties provided by the
95103 general law of this state, including Chapters 49 and 54, Water Code,
96104 applicable to municipal utility districts created under Section 59,
97105 Article XVI, Texas Constitution.
98106 Sec. 7917A.0303. AUTHORITY FOR ROAD PROJECTS. Under
99107 Section 52, Article III, Texas Constitution, the district may
100108 design, acquire, construct, finance, issue bonds for, improve,
101109 operate, maintain, and convey to this state, a county, or a
102110 municipality for operation and maintenance macadamized, graveled,
103111 or paved roads, or improvements, including storm drainage, in aid
104112 of those roads.
105113 Sec. 7917A.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
106114 road project must meet all applicable construction standards,
107115 zoning and subdivision requirements, and regulations of each
108116 municipality in whose corporate limits or extraterritorial
109117 jurisdiction the road project is located.
110118 (b) If a road project is not located in the corporate limits
111119 or extraterritorial jurisdiction of a municipality, the road
112120 project must meet all applicable construction standards,
113121 subdivision requirements, and regulations of each county in which
114122 the road project is located.
115123 (c) If the state will maintain and operate the road, the
116124 Texas Transportation Commission must approve the plans and
117125 specifications of the road project.
118126 Sec. 7917A.0305. COMPLIANCE WITH MUNICIPAL CONSENT
119127 ORDINANCE OR RESOLUTION. The district shall comply with all
120128 applicable requirements of any ordinance or resolution that is
121129 adopted under Section 54.016 or 54.0165, Water Code, and that
122130 consents to the creation of the district or to the inclusion of land
123131 in the district.
124132 Sec. 7917A.0306. DIVISION OF DISTRICT. (a) The district
125133 may be divided into two or more new districts only if the district:
126134 (1) has no outstanding bonded debt; and
127135 (2) is not imposing ad valorem taxes.
128136 (b) This chapter applies to any new district created by the
129137 division of the district, and a new district has all the powers and
130138 duties of the district.
131139 (c) A new district created by the division of the district
132140 may not, at the time the new district is created, contain any land
133141 outside the area described by Section 2 of the Act enacting this
134142 chapter.
135143 (d) The board, on its own motion or on receipt of a petition
136144 signed by the owner or owners of a majority of the assessed value of
137145 the real property in the district, may adopt an order dividing the
138146 district.
139147 (e) The board may adopt an order dividing the district
140148 before or after the date the board holds an election under Section
141149 7917A.0103 to confirm the district's creation.
142150 (f) An order dividing the district shall:
143151 (1) name each new district;
144152 (2) include the metes and bounds description of the
145153 territory of each new district;
146154 (3) appoint temporary directors for each new district;
147155 and
148156 (4) provide for the division of assets and liabilities
149157 between the new districts.
150158 (g) On or before the 30th day after the date of adoption of
151159 an order dividing the district, the district shall file the order
152160 with the commission and record the order in the real property
153161 records of each county in which the district is located.
154162 (h) A new district created by the division of the district
155163 shall hold a confirmation and directors' election as required by
156164 Section 7917A.0103. If the voters of a new district do not confirm
157165 the creation of the new district, the assets, obligations,
158166 territory, and governance of the new district revert to the
159167 original district.
160168 (i) If the creation of the new district is confirmed, the
161169 new district shall provide the election date and results to the
162170 commission.
163171 (j) Any new district created by the division of the district
164172 must hold an election as required by this chapter to obtain voter
165173 approval before the district may impose a maintenance tax or issue
166174 bonds payable wholly or partly from ad valorem taxes.
167175 (k) Municipal consent to the creation of the district and to
168176 the inclusion of land in the district granted under Section
169177 7917A.0104 acts as municipal consent to the creation of any new
170178 district created by the division of the district and to the
171179 inclusion of land in the new district.
172180 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
173181 Sec. 7917A.0401. ELECTIONS REGARDING TAXES OR BONDS. (a)
174182 The district may issue, without an election, bonds and other
175183 obligations secured by:
176184 (1) revenue other than ad valorem taxes; or
177185 (2) contract payments described by Section
178186 7917A.0403.
179187 (b) The district must hold an election in the manner
180188 provided by Chapters 49 and 54, Water Code, to obtain voter approval
181189 before the district may impose an ad valorem tax or issue bonds
182190 payable from ad valorem taxes.
183191 (c) The district may not issue bonds payable from ad valorem
184192 taxes to finance a road project unless the issuance is approved by a
185193 vote of a two-thirds majority of the district voters voting at an
186194 election held for that purpose.
187195 Sec. 7917A.0402. OPERATION AND MAINTENANCE TAX. (a) If
188196 authorized at an election held under Section 7917A.0401, the
189197 district may impose an operation and maintenance tax on taxable
190198 property in the district in accordance with Section 49.107, Water
191199 Code.
192200 (b) The board shall determine the tax rate. The rate may not
193201 exceed the rate approved at the election.
194202 Sec. 7917A.0403. CONTRACT TAXES. (a) In accordance with
195203 Section 49.108, Water Code, the district may impose a tax other than
196204 an operation and maintenance tax and use the revenue derived from
197205 the tax to make payments under a contract after the provisions of
198206 the contract have been approved by a majority of the district voters
199207 voting at an election held for that purpose.
200208 (b) A contract approved by the district voters may contain a
201209 provision stating that the contract may be modified or amended by
202210 the board without further voter approval.
203211 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
204212 Sec. 7917A.0501. AUTHORITY TO ISSUE BONDS AND OTHER
205213 OBLIGATIONS. The district may issue bonds or other obligations
206214 payable wholly or partly from ad valorem taxes, impact fees,
207215 revenue, contract payments, grants, or other district money, or any
208216 combination of those sources, to pay for any authorized district
209217 purpose.
210218 Sec. 7917A.0502. TAXES FOR BONDS. At the time the district
211219 issues bonds payable wholly or partly from ad valorem taxes, the
212220 board shall provide for the annual imposition of a continuing
213221 direct ad valorem tax, without limit as to rate or amount, while all
214222 or part of the bonds are outstanding as required and in the manner
215223 provided by Sections 54.601 and 54.602, Water Code.
216224 Sec. 7917A.0503. BONDS FOR ROAD PROJECTS. At the time of
217225 issuance, the total principal amount of bonds or other obligations
218226 issued or incurred to finance road projects and payable from ad
219227 valorem taxes may not exceed one-fourth of the assessed value of the
220228 real property in the district.
221229 SECTION 2. The Montgomery County Municipal Utility District
222230 No. 203 initially includes all the territory contained in the
223231 following area:
224232 Being 46.673 acres (2,033,071 square feet) of land situated
225233 in the Montgomery County School Land Survey, A-350, Montgomery
226234 County, Texas and being all of a called 29.201 acre tract conveyed
227235 to Bali Real Estate, LLC, by Warranty Deed recorded under Clerk's
228236 File No. 2019110268 of the Official Public Records of Montgomery
229237 County, Texas (O.P.R. M.C.T.), and all of the called 18.2958 acre
230238 tract conveyed to Bali Real Estate, LLC, by Warranty Deed recorded
231239 under Clerk's File No. 2019078899 O.P.R. M.C.T., said 46.673 acres
232240 being more particularly described by metes and bounds as follows:
233241 BEGINNING at a 1/2 inch iron pipe found in the west line of
234242 Lot 14B, Block 2, of Chateau Woods, Section Six, according to the
235243 Plat of same, recorded in Volume 7, Page 275, of the Map Records of
236244 Montgomery County, Texas (M.R. M.C.T.), for the southeast corner of
237245 Chateau Woods, according to the Plat of same, recorded in Cabinet Z,
238246 Sheet 536 M.R. M.C.T., and the northeast corner of said 18.2958 acre
239247 tract;
240248 THENCE South 04°24'53" East, with the west line of said
241249 Section Six, a distance of 329.67 feet to a 5/8 inch iron rod with
242250 cap marked "Landpoint 10194172" set for the southwest corner of Lot
243251 15C, of said Section Six, and an interior corner of the herein
244252 described tract;
245253 THENCE North 85°44'01" East, with the south line of said Lot
246254 15C, a distance of 155.60 feet to a 5/8 inch iron rod found in the
247255 west right of way (R.O.W.) line of Fairview Drive (60 foot wide
248256 R.O.W.) for the southeast corner of said Lot 15C, and an easterly
249257 northeast corner of the herein described tract;
250258 THENCE South 03°49'04" East, with said west right of way line,
251259 a distance of 70.00 feet to a 5/8 inch iron rod with cap marked
252260 "Landpoint 10194172" set for the northeast corner of Lot 16B, of
253261 said Section Six and an easterly southeast corner of the herein

414422 SECTION 3. (a) The legal notice of the intention to
415423 introduce this Act, setting forth the general substance of this
416424 Act, has been published as provided by law, and the notice and a
417425 copy of this Act have been furnished to all persons, agencies,
418426 officials, or entities to which they are required to be furnished
419427 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
420428 Government Code.
421429 (b) The governor, one of the required recipients, has
422430 submitted the notice and Act to the Texas Commission on
423431 Environmental Quality.
424432 (c) The Texas Commission on Environmental Quality has filed
425433 its recommendations relating to this Act with the governor, the
426434 lieutenant governor, and the speaker of the house of
427435 representatives within the required time.
428436 (d) All requirements of the constitution and laws of this
429437 state and the rules and procedures of the legislature with respect
430438 to the notice, introduction, and passage of this Act are fulfilled
431439 and accomplished.
432440 SECTION 4. (a) If this Act does not receive a two-thirds
433441 vote of all the members elected to each house, Subchapter C, Chapter
434442 7917A, Special District Local Laws Code, as added by Section 1 of
435443 this Act, is amended by adding Section 7917A.0307 to read as
436444 follows:
437445 Sec. 7917A.0307. NO EMINENT DOMAIN POWER. The district may
438446 not exercise the power of eminent domain.
439447 (b) This section is not intended to be an expression of a
440448 legislative interpretation of the requirements of Section 17(c),
441449 Article I, Texas Constitution.
442450 SECTION 5. This Act takes effect September 1, 2021.
