105 A BILL TO BE ENTITLED
116 AN ACT
127 relating to the sale of fireworks before and during the Diwali
138 holiday.
149 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1510 SECTION 1. Section 2154.202(h), Occupations Code, is
1611 amended to read as follows:
1712 (h) In addition to the periods during which the sale of
1813 fireworks is authorized under Subsection (g), the commissioners
1914 court of a county by order may allow a retail fireworks permit
2015 holder to sell fireworks in that county only to the public and only
2116 during one or more of the following periods:
2217 (1) beginning February 25 and ending at midnight on
2318 March 2;
2419 (2) beginning April 16 and ending at midnight on April
2520 21; [and]
2621 (3) beginning the Wednesday before the last Monday in
2722 May and ending at midnight on the last Monday in May; and
2823 (4) beginning five days before the first day of Diwali
2924 and ending at midnight on the last day of Diwali.
3025 SECTION 2. Sections 352.051(b) and (d), Local Government
3126 Code, are amended to read as follows:
3227 (b)(1) The Texas A&M Forest Service in the ordinary course
3328 of its activities shall determine whether drought conditions, as
3429 defined under Subsection (a)(2), exist on average in any county
3530 requesting such a determination. The Texas A&M Forest Service
3631 shall make available the measurement index guidelines used to
3732 determine whether drought conditions exist in a particular area.
3833 Following any determination that such drought conditions exist, the
3934 Texas A&M Forest Service shall notify said county or counties when
4035 such drought conditions no longer exist. The Texas A&M Forest
4136 Service shall make its services available each day during the Texas
4237 Independence Day, San Jacinto Day, Memorial Day, Fourth of July,
4338 Diwali, and December fireworks seasons to respond to the request of
4439 any county for a determination whether drought conditions exist on
4540 average in the county.
4641 (2) The Texas A&M Forest Service shall be allowed to
4742 take such donations of equipment or funds as necessary to aid in the
4843 carrying out of this section.
4944 (d) To facilitate compliance with an order adopted under
5045 Subsection (c), the order must be adopted before:
5146 (1) February 15 of each year for the Texas
5247 Independence Day fireworks season;
5348 (2) April 1 of each year for the San Jacinto Day
5449 fireworks season;
5550 (3) April 25 of each year for the Cinco de Mayo
5651 fireworks season;
5752 (4) May 15 of each year for the Memorial Day fireworks
5853 season;
5954 (5) June 15 of each year for the Fourth of July
6055 fireworks season; [and]
6156 (6) 15 days before the beginning of Diwali for the
6257 Diwali fireworks season; and
6358 (7) December 15 of each year for each December
6459 fireworks season.
6560 SECTION 3. This Act takes effect September 1, 2021.
