11+ A BILL TO BE ENTITLED
412 AN ACT
513 relating to the powers of the Hidalgo County Drainage District
614 Number 1; authorizing the issuance of bonds.
715 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
816 SECTION 1. In this Act, "district" means the Hidalgo County
917 Drainage District Number 1.
1018 SECTION 2. (a) District revenue bonds may be secured as
1119 described by a board resolution by a pledge of:
1220 (1) all or part of the district's gross revenue, other
1321 than taxation, minus the amount necessary to pay the cost of
1422 maintaining and operating the district and its property;
1523 (2) the net revenue of a contract made at any time; or
1624 (3) other revenue specified by board resolution.
1725 (b) The pledge may reserve the right to issue additional
1826 bonds on a parity with or subordinate to the bonds being issued,
1927 subject to conditions specified by the pledge.
2028 (c) District revenue bonds not payable wholly or partly from
2129 ad valorem taxes may be issued without an election.
2230 SECTION 3. (a) The district may sell reclaimed water at
2331 wholesale and sell reclaimed water on a retail basis to the extent
2432 that the sale does not conflict with a certificate of convenience
2533 and necessity.
2634 (b) The district may enter into public-private partnership
2735 agreements to fund infrastructure improvements needed to sell
2836 reclaimed water to consumers.
2937 SECTION 4. (a) The legal notice of the intention to
3038 introduce this Act, setting forth the general substance of this
3139 Act, has been published as provided by law, and the notice and a
3240 copy of this Act have been furnished to all persons, agencies,
3341 officials, or entities to which they are required to be furnished
3442 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3543 Government Code.
3644 (b) The governor, one of the required recipients, has
3745 submitted the notice and Act to the Texas Commission on
3846 Environmental Quality.
3947 (c) The Texas Commission on Environmental Quality has filed
4048 its recommendations relating to this Act with the governor, the
4149 lieutenant governor, and the speaker of the house of
4250 representatives within the required time.
4351 (d) All requirements of the constitution and laws of this
4452 state and the rules and procedures of the legislature with respect
4553 to the notice, introduction, and passage of this Act are fulfilled
4654 and accomplished.
4755 SECTION 5. This Act takes effect immediately if it receives
4856 a vote of two-thirds of all the members elected to each house, as
4957 provided by Section 39, Article III, Texas Constitution. If this
5058 Act does not receive the vote necessary for immediate effect, this
5159 Act takes effect September 1, 2021.
