8 | 17 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 18 | | SECTION 1. Section 136.001, Education Code, is amended by |
---|
10 | 19 | | adding Subdivision (5) to read as follows: |
---|
11 | 20 | | (5) "Veteran" means a person who has served in: |
---|
12 | 21 | | (A) the army, navy, air force, coast guard, or |
---|
13 | 22 | | marine corps of the United States; |
---|
14 | 23 | | (B) the state military forces as defined by |
---|
15 | 24 | | Section 431.001, Government Code, other than the Texas State Guard; |
---|
16 | 25 | | or |
---|
17 | 26 | | (C) an auxiliary service of one of those branches |
---|
18 | 27 | | of the armed forces. |
---|
19 | 28 | | SECTION 2. Section 136.005, Education Code, is amended to |
---|
20 | 29 | | read as follows: |
---|
21 | 30 | | Sec. 136.005. TEXAS INNOVATIVE ADULT CAREER EDUCATION (ACE) |
---|
22 | 31 | | GRANT PROGRAM. (a) The grant administrator shall establish and |
---|
23 | 32 | | administer the Texas Innovative Adult Career Education (ACE) Grant |
---|
24 | 33 | | Program to provide grants to: |
---|
25 | 34 | | (1) eligible nonprofit workforce intermediary and job |
---|
26 | 35 | | training organizations; and |
---|
27 | 36 | | (2) eligible nonprofit organizations providing job |
---|
28 | 37 | | training to veterans. |
---|
29 | 38 | | (a-1) In awarding grants under the program, the grant |
---|
30 | 39 | | administrator shall take into consideration the recommendations of |
---|
31 | 40 | | the program advisory board. |
---|
32 | 41 | | (b) Grants may be awarded under this chapter from the Texas |
---|
33 | 42 | | Innovative Adult Career Education (ACE) Grant fund only to develop, |
---|
34 | 43 | | support, or expand programs of eligible nonprofit workforce |
---|
35 | 44 | | intermediary and job training organizations and of eligible |
---|
36 | 45 | | nonprofit organizations providing job training to veterans to |
---|
37 | 46 | | prepare low-income students or veterans, as applicable, to enter |
---|
38 | 47 | | careers in high-demand and significantly higher-earning |
---|
39 | 48 | | occupations. |
---|
40 | 49 | | SECTION 3. Section 136.006, Education Code, is amended by |
---|
41 | 50 | | adding Subsection (a-1) and amending Subsection (b) to read as |
---|
42 | 51 | | follows: |
---|
43 | 52 | | (a-1) To be eligible for a grant under the program, a |
---|
44 | 53 | | nonprofit organization providing job training services to veterans |
---|
45 | 54 | | must: |
---|
46 | 55 | | (1) apply to the grant administrator in the manner |
---|
47 | 56 | | prescribed by the grant administrator; |
---|
48 | 57 | | (2) provide to veterans, in partnership with public |
---|
49 | 58 | | junior colleges, public state colleges, or public technical |
---|
50 | 59 | | institutes: |
---|
51 | 60 | | (A) job training; and |
---|
52 | 61 | | (B) a continuum of services designed to move a |
---|
53 | 62 | | program participant from application to employment, including |
---|
54 | 63 | | outreach, assessment, case management, support services, and |
---|
55 | 64 | | career placement; |
---|
56 | 65 | | (3) be governed by a board or other governing |
---|
57 | 66 | | structure that includes recognized leaders of broad-based |
---|
58 | 67 | | community organizations and executive-level or managerial-level |
---|
59 | 68 | | members of the local business community; |
---|
60 | 69 | | (4) demonstrate to the satisfaction of the program |
---|
61 | 70 | | advisory board that the organization's program has achieved or will |
---|
62 | 71 | | achieve the following measures of success among program |
---|
63 | 72 | | participants: |
---|
64 | 73 | | (A) the measures prescribed by Subsections |
---|
65 | 74 | | (a)(4)(A)-(C); |
---|
66 | 75 | | (B) rapid attainment of civilian workforce |
---|
67 | 76 | | credentials; and |
---|
68 | 77 | | (C) entry into careers with significantly higher |
---|
69 | 78 | | earnings for program participants than previously achieved; and |
---|
70 | 79 | | (5) provide matching funds in accordance with rules |
---|
71 | 80 | | adopted under this chapter. |
---|
72 | 81 | | (b) The matching funds required under Subsection (a)(5) or |
---|
73 | 82 | | (a-1)(5) may be obtained from any source available to the |
---|
74 | 83 | | organization, including in-kind contributions, community or |
---|
75 | 84 | | foundation grants, individual contributions, and local |
---|
76 | 85 | | governmental agency operating funds. The grant administrator may |
---|
77 | 86 | | adopt rules requiring an organization to demonstrate compliance |
---|
78 | 87 | | with the matching funds requirement before the payment of the next |
---|
79 | 88 | | installment under an awarded grant. |
---|
80 | 89 | | SECTION 4. This Act takes effect September 1, 2021. |
