9	5		A BILL TO BE ENTITLED
10	6		AN ACT
11	7		relating to establishment of the disaster identification system for
12	8		a declared state of disaster.
13	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	10		SECTION 1. Section 418.004, Government Code, is amended by
15	11		adding Subdivision (3-a) to read as follows:
16	12		(3-a) "Illuminated display" means a device that is
17	13		capable of displaying a flashing light and a continuous light in
18	14		either the color white or the colors blue, green, red, and yellow.
19	15		SECTION 2. Section 418.015(a), Government Code, is amended
20	16		to read as follows:
21	17		(a) An executive order or proclamation declaring a state of
22	18		disaster:
23	19		(1) activates the disaster recovery and
24	20		rehabilitation aspects of the state emergency management plan
25	21		applicable to the area subject to the declaration; [and]
26	22		(2) authorizes the deployment and use of any forces to
27	23		which the plan applies and the use or distribution of any supplies,
28	24		equipment, and materials or facilities assembled, stockpiled, or
29	25		arranged to be made available under this chapter or other law
30	26		relating to disasters; and
31	27		(3) activates for the area subject to the declaration
32	28		the disaster identification system described by Section 418.0151.
33	29		SECTION 3. Subchapter B, Chapter 418, Government Code, is
34	30		amended by adding Section 418.0151 to read as follows:
35	31		Sec. 418.0151. DISASTER IDENTIFICATION SYSTEM. (a) In an
36	32		area subject to a state of disaster declaration, a person may elect
37	33		to participate in the disaster identification system activated for
38	34		the area. The system must authorize the use of an illuminated
39	35		display to communicate with disaster relief personnel.
40	36		(b) A person participating in the disaster identification
41	37		system shall:
42	38		(1) affix to each individual and domesticated animal
43	39		in the person's household an illuminated display of the following
44	40		colors:
45	41		(A) if the person has a monochromatic illuminated
46	42		display, the color white for each individual and animal; or
47	43		(B) if the person has a multicolored illuminated
48	44		display:
49	45		(i) blue for each individual 18 years of age
50	46		or older;
51	47		(ii) green for each individual with a
52	48		disability;
53	49		(iii) red for each individual younger than
54	50		18 years of age; and
55	51		(iv) yellow for each animal; and
56	52		(2) using the illuminated display, signal to disaster
57	53		relief personnel responding to the area after the disaster with:
58	54		(A) a continuous light on the display of each
59	55		household member who does not need medical assistance; or
60	56		(B) a flashing light on the display of each
61	57		household member who needs medical assistance.
62	58		(c) Disaster relief personnel may patrol the designated
63	59		disaster area by air or ground at night to locate individuals or
64	60		animals with activated illuminated displays.
65	61		SECTION 4. Section 418.042(a), Government Code, is amended
66	62		to read as follows:
67	63		(a) The division shall prepare and keep current a
68	64		comprehensive state emergency management plan. The plan may
69	65		include:
70	66		(1) provisions for prevention and minimization of
71	67		injury and damage caused by disaster;
72	68		(2) provisions for prompt and effective response to
73	69		disaster;
74	70		(3) provisions for emergency relief;
75	71		(4) provisions for energy emergencies;
76	72		(5) identification of areas particularly vulnerable
77	73		to disasters;
78	74		(6) recommendations for zoning, building
79	75		restrictions, and other land-use controls, safety measures for
80	76		securing mobile homes or other nonpermanent or semipermanent
81	77		structures, and other preventive and preparedness measures
82	78		designed to eliminate or reduce disasters or their impact;
83	79		(7) provisions for assistance to local officials in
84	80		designing local emergency management plans;
85	81		(8) authorization and procedures for the erection or
86	82		other construction of temporary works designed to protect against
87	83		or mitigate danger, damage, or loss from flood, fire, or other
88	84		disaster;
89	85		(9) preparation and distribution to the appropriate
90	86		state and local officials of state catalogs of federal, state, and
91	87		private assistance programs;
92	88		(10) organization of manpower and channels of
93	89		assistance;
94	90		(11) coordination of federal, state, and local
95	91		emergency management activities;
96	92		(12) coordination of the state emergency management
97	93		plan with the emergency management plans of the federal government;
98	94		(13) coordination of federal and state energy
99	95		emergency plans;
100	96		(14) provisions for providing information to local
101	97		officials on activation of the Emergency Alert System established
102	98		under 47 C.F.R. Part 11;
103	99		(15) a database of public facilities that may be used
104	100		under Section 418.017 to shelter individuals during a disaster,
105	101		including air-conditioned facilities for shelter during an extreme
106	102		heat disaster and fortified structures for shelter during a wind
107	103		disaster;
108	104		(16) provisions for quickly replenishing the food
109	105		supplies of area food banks or food pantries following a disaster;
110	106		(17) provisions for the use of the disaster
111	107		identification system described by Section 418.0151; and
112	108		(18) [(17)] other necessary matters relating to
113	109		disasters.
114	110		SECTION 5. This Act takes effect September 1, 2021.
