79 relating to requiring entities that provide mental health services
810 to veterans or veterans' families to provide military informed care
911 or military cultural competency training to certain entity
1012 personnel to accept a grant from a state agency.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Section 434.352, Government Code, is amended by
1315 adding Subsections (e) and (f) to read as follows:
1416 (e) A state agency may not award a grant to an entity for the
1517 provision of mental health services to veterans or veterans'
1618 families unless the entity demonstrates that the entity:
1719 (1) has previously received and successfully executed
1820 a grant from the state agency; or
1921 (2) provides training on military informed care or
2022 military cultural competency to entity personnel who provide mental
2123 health services to veterans or veterans' families or requires those
2224 personnel to complete military competency training provided by any
2325 of the following:
2426 (A) the commission;
2527 (B) the Health and Human Services Commission;
2628 (C) the Military Veteran Peer Network;
2729 (D) the Substance Abuse and Mental Health
2830 Services Administration within the United States Department of
2931 Health and Human Services;
3032 (E) the United States Department of Defense;
3133 (F) the United States Department of Veterans
3234 Affairs; or
3335 (G) a nonprofit organization that is exempt from
3436 federal income taxation under Section 501(a), Internal Revenue Code
3537 of 1986, as amended, by being listed as an exempt entity under
3638 Section 501(c)(3), with experience in providing training or
3739 technical assistance to entities that provide mental health
3840 services to veterans or veterans' families.
3941 (f) The commission and the Department of State Health
4042 Services shall jointly undertake to ensure that a state agency that
4143 may award a grant subject to the requirements of Subsection (e) has
4244 adopted policies to ensure compliance with Subsection (e).
4345 SECTION 2. The heading to Subchapter I, Chapter 1001,
4446 Health and Safety Code, is amended to read as follows:
4547 SUBCHAPTER I. MENTAL HEALTH SERVICES [PROGRAM] FOR VETERANS
4648 SECTION 3. Subchapter I, Chapter 1001, Health and Safety
4749 Code, is amended by adding Section 1001.225 to read as follows:
4850 Sec. 1001.225. LIMITATION ON GRANTS. The department may
4951 not award a grant to an entity for the provision of mental health
5052 services to veterans or veterans' families unless the entity
5153 demonstrates that the entity:
5254 (1) has previously received and successfully executed
5355 a grant from the department; or
5456 (2) provides training on military informed care or
5557 military cultural competency to entity personnel who provide
5658 mental health services to veterans or veterans' families or
5759 requires those personnel to complete military competency training
5860 provided by any of the following:
5961 (A) the Texas Veterans Commission;
6062 (B) the commission;
6163 (C) the Military Veteran Peer Network;
6264 (D) the Substance Abuse and Mental Health
6365 Services Administration within the United States Department of
6466 Health and Human Services;
6567 (E) the United States Department of Defense;
6668 (F) the United States Department of Veterans
6769 Affairs; or
6870 (G) a nonprofit organization that is exempt from
6971 federal income taxation under Section 501(a), Internal Revenue Code
7072 of 1986, as amended, by being listed as an exempt entity under
7173 Section 501(c)(3), with experience in providing training or
7274 technical assistance to entities that provide mental health
7375 services to veterans or veterans' families.
7476 SECTION 4. This Act takes effect September 1, 2021.
