5 | 11 | | relating to the carrying and possession of a handgun by a public |
---|
6 | 12 | | junior college school marshal. |
---|
7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Section 51.220(e), Education Code, is amended to |
---|
9 | 15 | | read as follows: |
---|
10 | 16 | | (e) Any written regulations adopted for purposes of |
---|
11 | 17 | | Subsection (d): |
---|
12 | 18 | | (1) must: |
---|
13 | 19 | | (A) authorize [provide that] a school marshal to |
---|
14 | 20 | | [may] carry a concealed handgun as described by Subsection (d); and |
---|
15 | 21 | | (B) [, except that if the primary duty of the |
---|
16 | 22 | | school marshal involves regular, direct contact with students, the |
---|
17 | 23 | | marshal may not carry a concealed handgun but may possess a handgun |
---|
18 | 24 | | on the physical premises of a public junior college campus in a |
---|
19 | 25 | | locked and secured safe within the marshal's immediate reach when |
---|
20 | 26 | | conducting the marshal's primary duty. The written regulations must |
---|
21 | 27 | | also] require [that] a handgun carried or possessed by [or within |
---|
22 | 28 | | access of] a school marshal to [may] be loaded only with frangible |
---|
23 | 29 | | duty ammunition approved for that purpose by the Texas Commission |
---|
24 | 30 | | on Law Enforcement; and |
---|
25 | 31 | | (2) may not require a school marshal to store the |
---|
26 | 32 | | handgun in a locked container while on duty. |
---|
27 | 33 | | SECTION 2. This Act applies beginning with the 2021-2022 |
---|
28 | 34 | | academic year. |
---|
29 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
---|
30 | 36 | | a vote of two-thirds of all the members elected to each house, as |
---|
31 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
32 | 38 | | Act does not receive the vote necessary for immediate effect, this |
---|
33 | 39 | | Act takes effect September 1, 2021. |
