9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the carrying and possession of a handgun by a public
612 junior college school marshal.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 51.220(e), Education Code, is amended to
915 read as follows:
1016 (e) Any written regulations adopted for purposes of
1117 Subsection (d):
1218 (1) must:
1319 (A) authorize [provide that] a school marshal to
1420 [may] carry a concealed handgun as described by Subsection (d); and
1521 (B) [, except that if the primary duty of the
1622 school marshal involves regular, direct contact with students, the
1723 marshal may not carry a concealed handgun but may possess a handgun
1824 on the physical premises of a public junior college campus in a
1925 locked and secured safe within the marshal's immediate reach when
2026 conducting the marshal's primary duty. The written regulations must
2127 also] require [that] a handgun carried or possessed by [or within
2228 access of] a school marshal to [may] be loaded only with frangible
2329 duty ammunition approved for that purpose by the Texas Commission
2430 on Law Enforcement; and
2531 (2) may not require a school marshal to store the
2632 handgun in a locked container while on duty.
2733 SECTION 2. This Act applies beginning with the 2021-2022
2834 academic year.
2935 SECTION 3. This Act takes effect immediately if it receives
3036 a vote of two-thirds of all the members elected to each house, as
3137 provided by Section 39, Article III, Texas Constitution. If this
3238 Act does not receive the vote necessary for immediate effect, this
3339 Act takes effect September 1, 2021.
