4	11		AN ACT
5	12		relating to the Texas natural gas vehicle grant program.
6	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	14		SECTION 1. Section 394.003, Health and Safety Code, is
8	15		amended by amending Subsection (a) and adding Subsection (c) to
9	16		read as follows:
10	17		(a) A vehicle is a qualifying vehicle that may be considered
11	18		for a grant under the program if during the eligibility period
12	19		established by the commission the entity:
13	20		(1) purchased, leased, or otherwise commercially
14	21		financed the vehicle as an [a new] on-road heavy-duty or
15	22		medium-duty motor vehicle that:
16	23		(A) is a new natural gas vehicle or, subject to
17	24		Subsection (c), a used natural gas vehicle;
18	25		(B) is certified to the appropriate current
19	26		federal emissions standards as determined by the commission; and
20	27		(C) replaces an on-road heavy-duty or
21	28		medium-duty motor vehicle of the same weight classification and
22	29		use; or
23	30		(2) repowered the on-road motor vehicle to a natural
24	31		gas vehicle powered by a natural gas engine that is certified to the
25	32		appropriate current federal emissions standards as determined by
26	33		the commission.
27	34		(c) A used natural gas vehicle that is proposed to replace
28	35		an on-road heavy-duty or medium-duty motor vehicle must be of model
29	36		year 2017 or later, provided that the model year may not be more
30	37		than six years older than the current model year at the time of the
31	38		submission of the grant application.
32	39		SECTION 2. Section 394.005(b), Health and Safety Code, is
33	40		amended to read as follows:
34	41		(b) To be eligible for a grant under the program:
35	42		(1) the use of the qualifying vehicle must be
36	43		projected to result in a reduction in emissions of nitrogen oxides
37	44		of at least 25 percent as compared to the motor vehicle or engine
38	45		being replaced, based on:
39	46		(A) the baseline emission level set by the
40	47		commission under Subsection (g); and
41	48		(B) the certified emission rate of the qualifying
42	49		[new] vehicle; and
43	50		(2) the qualifying vehicle must:
44	51		(A) replace a heavy-duty or medium-duty motor
45	52		vehicle that:
46	53		(i) is an on-road vehicle that has been
47	54		owned, leased, or otherwise commercially financed and registered
48	55		and operated by the applicant in Texas for at least the two years
49	56		immediately preceding the submission of a grant application;
50	57		(ii) satisfies any minimum average annual
51	58		mileage or fuel usage requirements established by the commission;
52	59		(iii) satisfies any minimum percentage of
53	60		annual usage requirements established by the commission; and
54	61		(iv) is in operating condition and has at
55	62		least two years of remaining useful life, as determined in
56	63		accordance with criteria established by the commission;
57	64		(B) replace a heavy-duty or medium-duty motor
58	65		vehicle that:
59	66		(i) is owned by the applicant;
60	67		(ii) is an on-road vehicle that has been:
61	68		(a) owned, leased, or otherwise
62	69		commercially financed and operated in Texas as a fleet vehicle for
63	70		at least the two years immediately preceding the submission of a
64	71		grant application; and
65	72		(b) registered in a county located in
66	73		the clean transportation zone for at least the two years
67	74		immediately preceding the submission of a grant application; and
68	75		(iii) otherwise satisfies the mileage,
69	76		usage, and useful life requirements established under Paragraph (A)
70	77		as determined by documentation associated with the vehicle; or
71	78		(C) be a heavy-duty or medium-duty motor vehicle
72	79		repowered with a natural gas engine that:
73	80		(i) is installed in an on-road vehicle that
74	81		has been owned, leased, or otherwise commercially financed and
75	82		registered and operated by the applicant in Texas for at least the
76	83		two years immediately preceding the submission of a grant
77	84		application;
78	85		(ii) satisfies any minimum average annual
79	86		mileage or fuel usage requirements established by the commission;
80	87		(iii) satisfies any minimum percentage of
81	88		annual usage requirements established by the commission; and
82	89		(iv) is installed in an on-road vehicle
83	90		that, at the time of the vehicle's repowering, was in operating
84	91		condition and had at least two years of remaining useful life, as
85	92		determined in accordance with criteria established by the
86	93		commission.
87	94		SECTION 3. This Act takes effect September 1, 2021.
