44 A JOINT RESOLUTION
55 proposing a constitutional amendment providing for the creation of
66 the water infrastructure resiliency fund and the critical
77 infrastructure resiliency fund to assist in the financing of
88 certain infrastructure projects.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article III, Texas Constitution, is amended by
1111 adding Section 49-d-15 to read as follows:
1212 Sec. 49-d-15. (a) The water infrastructure resiliency fund
1313 is created as a special fund in the state treasury outside the
1414 general revenue fund.
1515 (b) As provided by general law, money in the water
1616 infrastructure resiliency fund may be administered and used,
1717 without further appropriation, by the Texas Water Development Board
1818 or that board's successor in function to provide financing for
1919 weatherizing and hardening water and wastewater systems
2020 (c) Separate accounts may be established in the water
2121 infrastructure resiliency fund as necessary to administer the fund
2222 or authorized projects.
2323 SECTION 2. Article III, Texas Constitution, is amended by
2424 adding Section 49-q to read as follows:
2525 Sec. 49-q. (a) The critical infrastructure resiliency fund
2626 is created as a special fund in the state treasury outside the
2727 general revenue fund.
2828 (b) As provided by general law, money in the critical
2929 infrastructure resiliency fund may be administered and used,
3030 without further appropriation, by the Texas Division of Emergency
3131 Management or that division's successor in function to provide
3232 financing for:
3333 (1) localized improvements to the electric grid;
3434 (2) improvements at and between buildings to create
3535 micro-grids;
3636 (2) hardening lines of emergency communication; and
3737 (3) purchasing reserve power supply such as onsite
3838 generation and energy storage systems necessary to sustain:
3939 (A) emergency communications; and
4040 (B) critical medical care.
4141 (c) Separate accounts may be established in the critical
4242 infrastructure resiliency fund as necessary to administer the fund
4343 or authorized projects.
4444 SECTION 3. This proposed constitutional amendment shall be
4545 submitted to the voters at an election to be held November 2, 2021.
4646 The ballot shall be printed to permit voting for or against the
4747 proposition: "The constitutional amendment providing for the
4848 creation of the modern infrastructure fund to assist in the
4949 financing of modern electric, transportation, and communications
5050 infrastructure projects."
