510 proposing a constitutional amendment authorizing the professional
611 sports team charitable foundations of organizations sanctioned by
712 certain professional associations to conduct charitable raffles at
813 rodeo venues.
914 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1015 SECTION 1. Section 47(d-1), Article III, Texas
1116 Constitution, is amended to read as follows:
1217 (d-1) The legislature by general law may permit a
1318 professional sports team charitable foundation to conduct
1419 charitable raffles under the terms and conditions imposed by
1520 general law. The law may authorize the charitable foundation to pay
1621 with the raffle proceeds reasonable advertising, promotional, and
1722 administrative expenses. A law enacted under this subsection
1823 applies only to an entity defined as a professional sports team
1924 charitable foundation under that law and may only allow charitable
2025 raffles to be conducted at games or rodeo events hosted at the home
2126 venue of the professional sports team associated with a
2227 professional sports team charitable foundation. In this
2328 subsection, "professional sports team" means:
2429 (1) a team organized in this state that is a member of
2530 Major League Baseball, the National Basketball Association, the
2631 National Hockey League, the National Football League, Major League
2732 Soccer, the American Hockey League, the East Coast Hockey League,
2833 the American Association of Independent Professional Baseball, the
2934 Atlantic League of Professional Baseball, Minor League Baseball,
3035 the National Basketball Association Development League, the
3136 National Women's Soccer League, the Major Arena Soccer League, the
3237 United Soccer League, or the Women's National Basketball
3338 Association;
3439 (2) a person hosting a motorsports racing team event
3540 sanctioned by the National Association for Stock Car Auto Racing
3641 (NASCAR), INDYCar, or another nationally recognized motorsports
3742 racing association at a venue in this state with a permanent seating
3843 capacity of not less than 75,000;
3944 (3) an organization hosting a Professional Golf
4045 Association event; [or]
4146 (4) an organization sanctioned by the Professional
4247 Rodeo Cowboys Association or the Women's Professional Rodeo
4348 Association; or
4449 (5) any other professional sports team defined by law.
4550 SECTION 2. This proposed constitutional amendment shall be
4651 submitted to the voters at an election to be held November 2, 2021.
4752 The ballot shall be printed to provide for voting for or against the
4853 proposition: "The constitutional amendment authorizing the
4954 professional sports team charitable foundations of organizations
5055 sanctioned by the Professional Rodeo Cowboys Association or the
5156 Women's Professional Rodeo Association to conduct charitable
5257 raffles at rodeo venues."
