9 | 14 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 15 | | SECTION 1. Section 47(d-1), Article III, Texas |
---|
11 | 16 | | Constitution, is amended to read as follows: |
---|
12 | 17 | | (d-1) The legislature by general law may permit a |
---|
13 | 18 | | professional sports team charitable foundation to conduct |
---|
14 | 19 | | charitable raffles under the terms and conditions imposed by |
---|
15 | 20 | | general law. The law may authorize the charitable foundation to pay |
---|
16 | 21 | | with the raffle proceeds reasonable advertising, promotional, and |
---|
17 | 22 | | administrative expenses. A law enacted under this subsection |
---|
18 | 23 | | applies only to an entity defined as a professional sports team |
---|
19 | 24 | | charitable foundation under that law and may only allow charitable |
---|
20 | 25 | | raffles to be conducted at games or rodeo events hosted at the home |
---|
21 | 26 | | venue of the professional sports team associated with a |
---|
22 | 27 | | professional sports team charitable foundation. In this |
---|
23 | 28 | | subsection, "professional sports team" means: |

24 | 29 | | (1) a team organized in this state that is a member of |
---|
25 | 30 | | Major League Baseball, the National Basketball Association, the |
---|
26 | 31 | | National Hockey League, the National Football League, Major League |
---|
27 | 32 | | Soccer, the American Hockey League, the East Coast Hockey League, |
---|
28 | 33 | | the American Association of Independent Professional Baseball, the |
---|
29 | 34 | | Atlantic League of Professional Baseball, Minor League Baseball, |
---|
30 | 35 | | the National Basketball Association Development League, the |
---|
31 | 36 | | National Women's Soccer League, the Major Arena Soccer League, the |
---|
32 | 37 | | United Soccer League, or the Women's National Basketball |
---|
33 | 38 | | Association; |
---|
34 | 39 | | (2) a person hosting a motorsports racing team event |
---|
35 | 40 | | sanctioned by the National Association for Stock Car Auto Racing |
---|
36 | 41 | | (NASCAR), INDYCar, or another nationally recognized motorsports |
---|
37 | 42 | | racing association at a venue in this state with a permanent seating |
---|
38 | 43 | | capacity of not less than 75,000; |
---|
39 | 44 | | (3) an organization hosting a Professional Golf |
---|
40 | 45 | | Association event; [or] |
---|
41 | 46 | | (4) an organization sanctioned by the Professional |
---|
42 | 47 | | Rodeo Cowboys Association or the Women's Professional Rodeo |
---|
43 | 48 | | Association; or |
---|
44 | 49 | | (5) any other professional sports team defined by law. |

45 | 50 | | SECTION 2. This proposed constitutional amendment shall be |

46 | 51 | | submitted to the voters at an election to be held November 2, 2021. |

47 | 52 | | The ballot shall be printed to provide for voting for or against the |

48 | 53 | | proposition: "The constitutional amendment authorizing the |
