| 9 | 9 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Article I, Texas Constitution, is amended by | |
| 11 | 11 | adding Section 35 to read as follows: | |
| 12 | 12 | Sec. 35. (a) An individual has the right to engage in a | |
| 13 | 13 | lawful occupation or profession free from unnecessary regulation. | |
| 14 | 14 | (b) This state or a political subdivision of this state may | |
| 15 | 15 | not enact or enforce a regulation that imposes a substantial burden | |
| 16 | 16 | on an individual's right to engage in a lawful occupation or | |
| 17 | 17 | profession unless the regulation is necessary and narrowly tailored | |
| 18 | 18 | to protect against actual and specific harm to the public's health | |
| 19 | 19 | and safety. | |
| 20 | 20 | SECTION 2. This proposed constitutional amendment shall be | |
| 21 | 21 | submitted to the voters at an election to be held on November 2, | |
| 22 | 22 | 2021. The ballot shall be printed to permit voting for or against | |
| 23 | 23 | the proposition: "The constitutional amendment protecting an | |
| 24 | 24 | individual's right to earn a living free from unnecessary | |
| 25 | 25 | governmental interference." |
