| 11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 47, Article III, Texas Constitution, is |
|---|
| 13 | 13 | | amended by amending Subsection (e) and adding Subsection (f) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (e) The Legislature by general law may authorize the State |
|---|
| 16 | 16 | | to operate lotteries and may authorize the State to enter into a |
|---|
| 17 | 17 | | contract with one or more legal entities that will operate |
|---|
| 18 | 18 | | lotteries on behalf of the State. All money received by the State |
|---|
| 19 | 19 | | from the operation of lotteries, other than amounts paid for |
|---|
| 20 | 20 | | administrative costs, lottery prizes, and unclaimed lottery |
|---|
| 21 | 21 | | prizes, is dedicated to and may be expended only for the enrichment |
|---|
| 22 | 22 | | of educational programs in the State's public primary and secondary |
|---|
| 23 | 23 | | schools that directly benefit classroom teaching, including |
|---|
| 24 | 24 | | teacher compensation and the acquisition of educational materials |
|---|
| 25 | 25 | | and services. |
|---|
| 26 | 26 | | (f) The State, a state agency or political subdivision of |
|---|
| 27 | 27 | | the state, a legal entity contracting to operate lotteries |
|---|
| 28 | 28 | | authorized by Subsection (e) of this section, or a holder of a |
|---|
| 29 | 29 | | license issued by the State related to the operation of a lottery |
|---|
| 30 | 30 | | authorized by that subsection may not sponsor an advertisement or |
|---|
| 31 | 31 | | promotion that encourages or attempts to influence a person to |
|---|
| 32 | 32 | | purchase a lottery ticket by stating or implying the revenue |
|---|
| 33 | 33 | | generated from the ticket sale will financially assist the State's |
|---|
| 34 | 34 | | public primary or secondary schools. |
|---|
| 35 | 35 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 36 | 36 | | submitted to the voters at an election to be held November 2, 2021. |
|---|
| 37 | 37 | | The ballot shall be printed to permit voting for or against the |
|---|
| 38 | 38 | | proposition: "The constitutional amendment to dedicate net state |
|---|
| 39 | 39 | | lottery revenue to support educational programs that benefit |
|---|
| 40 | 40 | | classroom teaching in public schools and to prohibit advertisements |
|---|
| 41 | 41 | | and promotions that state or imply lottery ticket sales revenue |
|---|
| 42 | 42 | | will financially assist public schools." |
