55 A JOINT RESOLUTION
66 proposing a constitutional amendment to dedicate net state lottery
77 revenue to support educational programs that benefit classroom
88 teaching in public schools and to prohibit advertisements and
99 promotions that state or imply lottery ticket sales revenue will
1010 financially assist public schools.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 47, Article III, Texas Constitution, is
1313 amended by amending Subsection (e) and adding Subsection (f) to
1414 read as follows:
1515 (e) The Legislature by general law may authorize the State
1616 to operate lotteries and may authorize the State to enter into a
1717 contract with one or more legal entities that will operate
1818 lotteries on behalf of the State. All money received by the State
1919 from the operation of lotteries, other than amounts paid for
2020 administrative costs, lottery prizes, and unclaimed lottery
2121 prizes, is dedicated to and may be expended only for the enrichment
2222 of educational programs in the State's public primary and secondary
2323 schools that directly benefit classroom teaching, including
2424 teacher compensation and the acquisition of educational materials
2525 and services.
2626 (f) The State, a state agency or political subdivision of
2727 the state, a legal entity contracting to operate lotteries
2828 authorized by Subsection (e) of this section, or a holder of a
2929 license issued by the State related to the operation of a lottery
3030 authorized by that subsection may not sponsor an advertisement or
3131 promotion that encourages or attempts to influence a person to
3232 purchase a lottery ticket by stating or implying the revenue
3333 generated from the ticket sale will financially assist the State's
3434 public primary or secondary schools.
3535 SECTION 2. This proposed constitutional amendment shall be
3636 submitted to the voters at an election to be held November 2, 2021.
3737 The ballot shall be printed to permit voting for or against the
3838 proposition: "The constitutional amendment to dedicate net state
3939 lottery revenue to support educational programs that benefit
4040 classroom teaching in public schools and to prohibit advertisements
4141 and promotions that state or imply lottery ticket sales revenue
4242 will financially assist public schools."
