46 AN ACT
57 relating to background and criminal history checks for operators
68 and employees of certain child-care facilities.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 42.159, Human Resources Code, is amended
911 by adding Subsections (b-1), (b-2), and (c-1) to read as follows:
1012 (b-1) A person subject to the background and criminal
1113 history check required by Subsection (a) or (b) shall submit to the
1214 commission a complete set of fingerprints.
1315 (b-2) The executive commissioner shall adopt rules to
1416 implement this section. The rules adopted under this section:
1517 (1) must require that the fingerprints submitted be in
1618 a form and of a quality acceptable to the Department of Public
1719 Safety and the Federal Bureau of Investigation for the purpose of
1820 conducting a criminal history check;
1921 (2) may require that the fingerprints be submitted
2022 electronically through an applicant fingerprinting service center;
2123 and
2224 (3) may allow the commission to waive a fingerprint
2325 submission required by this section if:
2426 (A) the person for whom the submission is
2527 required has:
2628 (i) a fingerprint-based criminal history
2729 check on file with the commission obtained under Section 411.114,
2830 Government Code; or
2931 (ii) a fingerprint-based criminal history
3032 clearinghouse record, as provided by Section 411.0845, Government
3133 Code, that is accessible to the commission through the Department
3234 of Public Safety and obtained under Section 411.114, Government
3335 Code; and
3436 (B) the commission has an active subscription to
3537 the Federal Bureau of Investigation's National Record of Arrest and
3638 Prosecution Back Service for the person for whom the fingerprint
3739 submission is required.
3840 (c-1) For each person whose fingerprints are submitted
3941 under Subsection (b-1), the department shall conduct a state and
4042 Federal Bureau of Investigation criminal history check by:
4143 (1) submitting the person's fingerprints, or causing
4244 the fingerprints to be submitted electronically, to the Department
4345 of Public Safety for the purpose of conducting a state and federal
4446 criminal history check; and
4547 (2) using the resulting information made available by
4648 that department under Section 411.114, Government Code, and by the
4749 Federal Bureau of Investigation and any other criminal justice
4850 agency under Section 411.087, Government Code.
4951 SECTION 2. Section 42.206, Human Resources Code, is amended
5052 by amending Subsection (b) and adding Subsections (b-1) and (c-1)
5153 to read as follows:
5254 (b) In addition to the requirements of Subsection (a), a
5355 shelter shall submit a complete set of fingerprints of each person
5456 required to undergo a criminal history check under Subsection (a)
5557 [if:
5658 [(1) the person has lived outside the state at any time
5759 during the previous five years; or
5860 [(2) the shelter has reason to suspect that the person
5961 has a criminal history in another state].
6062 (b-1) The executive commissioner shall adopt rules to
6163 implement this section. The rules adopted under this section:
6264 (1) must require that the fingerprints submitted be in
6365 a form and of a quality acceptable to the Department of Public
6466 Safety and the Federal Bureau of Investigation for purposes of
6567 conducting a criminal history check;
6668 (2) may require that the fingerprints be submitted
6769 electronically through an applicant fingerprinting service center;
6870 and
6971 (3) may allow the commission to waive a fingerprint
7072 submission required by this section if:
7173 (A) the person for whom the submission is
7274 required has:
7375 (i) a fingerprint-based criminal history
7476 check on file with the commission obtained under Section 411.114,
7577 Government Code; or
7678 (ii) a fingerprint-based criminal history
7779 clearinghouse record, as provided by Section 411.0845, Government
7880 Code, that is accessible to the commission through the Department
7981 of Public Safety and obtained under Section 411.114, Government
8082 Code; and
8183 (B) the commission has an active subscription to
8284 the Federal Bureau of Investigation's National Record of Arrest and
8385 Prosecution Back Service for the person for whom the fingerprint
8486 submission is required.
8587 (c-1) For each person whose fingerprints are submitted
8688 under Subsection (b), the department shall conduct a state and
8789 Federal Bureau of Investigation criminal history check by:
8890 (1) submitting the person's fingerprints, or causing
8991 the fingerprints to be submitted electronically, to the Department
9092 of Public Safety for the purpose of conducting a state and federal
9193 criminal history check; and
9294 (2) using the resulting information made available by
9395 that department under Section 411.114, Government Code, and by the
9496 Federal Bureau of Investigation and any other criminal justice
9597 agency under Section 411.087, Government Code.
9698 SECTION 3. This Act takes effect September 1, 2021.
